  1. Oh, beautiful Fort Lee, how I've missed you. Only two hours from Washington, D.C. and no real peace time missions for my MOS.

    After Desert Storm from Fort Riley, I (77F now 92W MOS) was assigned to Fort Lee via 109th QM Company from Dec 92 to Aug 94!!! We may know one another!!!

    If you look at my avatar picture, you'll see that FORSCOM patch represents my Fort Lee assignment!!!!

  2. Hi All,

    The vet I am helping went back to his orthopedic doctor and his doctor would not use the words at least as likely as not because he felt that his statement was strong enough. This is the doctor's statement: "The patient comes into the office for evaluagtion of several different problems. The patient is a 73 year old male who comes in primarily for pain in b oth knees and lower back. The had previous left knee surgery in 1954, service connected where he was injured. it is unclear what was done, but he has two screws still remaining in the knee afterward. He has had progressive knee pain over the past years, which because of the way he has been walking has started to affect his other knee as well as his lower back." His doctor feels that because he used the words because of the way he has been walking, etc. that this makes the statement strong enough.

    What do you all think is this strong enough to link his other knee and lower back.

    Also, doctor states: "At the present time, the patient is unemployable since ambulation for any long periods of time bothers him and he cannot stand for a long period of time, anything longer than 20 minutes of the time and also, when he sits in one position for a while his legs staqrt to cramp up and bother him as well as pain in the lower back, so he has got to get up and move." My question is Do you now think this statement is strong enough for his TDIU claim to be awarded.

    For those of you who haven't read TDIU Doctor's Opinion - Would This Work, I suggest doing so because it answers all questions about ROM, etc.

    IMHO, I would recommend that you contact the local VARO and get him an appointment to see a VOC REHAB counselor. Have the VOC Rehab counselor write a letter stating that he would not benefit from future training thus making him unemployable!

    I was denied TDIU until I had my Voc Rehab counselor write said letter, then one week later I was awarded TDIU solely based on his letter! I hope this help!

  3. Thats totally false. Its not your age that stops you from getting SSD, its the number of quarters/ work credits you qualify for. You can get SSD if you:

    * you have enough work credits,

    * you have enough recent work and

    * your medical condition meets the disability rules.

    That's what it might say, but we ALL know that SSA don't follow their own procedures or policies! Go Figure!

    My lawyer said the same thing about the my age and being DENIED. I'm TDIU, so go figure!!!

    Have you asked VocRec for an in-home assessment (independent living services)? This WILL help your claim for IU! This will show what your daily routine is currently, what time you get up, who cooks, cleans, does the yard work, etc. etc!

    I had an ILS counselor come to my house, was the best thing that I could have done. Once the counselor was in my home, we had a discussion about my current unemployment and future employment. Once he told me that I was unemployable thru our conversation for my SC'd conditions, I then asked if he could put that down in a letter for me. HE DID, and once the rater seen that letter from him. BAM!!! I was awarded IU immediately!!

  5. My wife wants to know how to get government health insurance and at what rating you have to be to get it. We currently pay a $6000.00 deductable which eats away at your saving very quickly and still doesn't cover much. :D

    Jeff....in order to qualify for ChampVA...you must be SC'd @ 100% P&T or TDIU!

  6. I finally put in for 100 ui but was denied b/c i was trying to do vre.

    Are you still working with the VRE counselor that you seen?

    If you are, try contacting them or go see them in person and have the VRE counselor write a letter stating that you will not benefit from any of the VRE education/re-training, thus making you unemployable!

    This was done in my case and was awarded IU with said letter above!

  7. That is true about the Medicare, the only problema that I see is that, after you wait the requisite 5 months that SSD holds you back.........then it is two years before Medicare kicks in. In other words, IF everything goes RIGHT vis a vis the Medicare claim, it's two and one half years before Medicare.

  8. About 5 years ago after I returned from Iraq, I filed a claim for compensation and was awarded 100% for PTSD, but not p&t. The award letter stated that there would be a future examination on my claim. Well, I thought by now I would have been reevaluated. My spouse and I recently moved to Texas, and she has not been able to find employment yet, and has no medical insurance. I understand she is not eligible for CHAMPVA because I'm not p&t. Is there something she does qualify for her medical? She is a diabetic and her medical expenses are piling up on us right now. Thanks in advance for any insight you might be able to provide.

    Have you applied for SSD? You will get medicare for your dependents if you are approved for SSD but you need to file a claim!

    I would advise you do it as soon as possible.

  9. Back in Mar of 2007 I had a spinal fusion which was my second and about three day prior I had a knee surgery for a torn acl. Level 3/4 Comdalacia (aurthis of the joint.) I started filing for the Convalance for both of the surgries and then an increase for the for the knee. I was Maxed out on the back and could get any higher ratings. I thought it a very simple claim, but right after it made it through the rater it was pulled by a STAR review. During the star revriew it was discovered that I had two deffered issued from my first back surgery back in 2008. One for Major Depression and one for EDD. They sent me for C/Ps wich I accomplshed and then it was in development forever it seemed. Finally it went to the rater and some how they let it slip away fro the and it delayed it agian. Finally as of April 8th 2010 I recieved a package from the VA stating the had raised my combined rating to 80% doc dated to March 2008. Some how the RO loged it in as completed,but because it wasn't cleared in the computer it sat there for about three weeks and then they discovered it had not been released to the Department of Treasury. My question is how long will they take now. I know there is alot of crdp involved to be figured, but I'm hoping that they get a VA check out pretty quick. I don't seem to know if there will be one deposit or two seperate because of all the back pay owed due to VA waiver ammount. I just want the A part then I can worry about the DFAS portion/taxes. Oh by the way I had another back surgery in March this year I didn't file for it because it would be moot due to I filed for IU I did

    Hopeful this will explain alittle more of why I trying to understand process

    Are you using the LR VARO? I live in the Arkansas Ozarks brotha! I have a few contacts in NLR and LR VARO!
