  1. How long does it usually take for things to start moving? I went in for my meeting Sept 28th and took the test.

    Few months? Several Months? I haven't heard one thing from my counselor since my meeting.

    I really am having a hard time at my job because of my disability. I missed last night and tonight because of pain. We are on an 8 point attendance system and I have racked up 4 points since April (my start date).

    I am extremely stressed out and losing hope in everything.

    Since you are 10% SC for your back......I would recommend that you start getting treatment from the VA to document your case, nevertheless, to get some pain relief.

    Are you currently being seen by the VA on a regular basis for your back? If not, why not?

    It's crucial to have medical evidence about your condition as you will have to have it, to file for an increase now and later on............just sayin!

  2. After my rating was increased to 70% due to appeal, the TDIU went rather quickly,I am 30% for Larynx cancer and 40% for major depression. I had 3 C&P exams, one for blood work, one with a ear nose and throat doctor and one with a shrink. All were very nice and listened to what my wife had to say. My VASO was also very helpful. I am thankful for all who post here. I read almost all post and got a lot of good advise. My experience with the VA has been a positive one. I am attending PTSD classes and trying to cope with the loss of vocal cords, my job etc. The TDIU sure is a big help. Good luck to all getting what is well deserved. My advise would be to be nice to the examiner, I think it is important for him to like you. It also helps to have all your ducks in order.

    Congrats! That was fast for getting awarded TDIU! I thought the 7 months for myself was quick but 5 is insane! Great job! IMHO, if you are well-documented in your medical evidence then how could VA deny you! But we all know the pit-falls of the VA and luck of the draw when it comes to the rater you are given to review your claim.........I'm a firm believer that getting the right rater to review your claim is key.......I've been lucky thus far!

    Good Luck to those still fighting with the VA........keep up the good fight.......don't settle for NO! You deserve the benefits, fight the VA to the end!

  3. My 30 day reconsider notice deadline is coming up on Sept.13. My NOD deadline is July 13, 2011. I really need some advice folks! I was denide TDIU on July 13 for my TKR I had in 2008 that was rated 60%. Reason for denial; I was able to do sedentary work. I filed a reconsider notice with statements from my Pain Dr saying I couldn't sit more than 15 minutes and the meds I'm taking causes me to have poor concentration and memory loss. It's his opinion is that it is more likely than not that I will have difficulty maintaining long-term gainful employment. I realize this is far from an IMO. I didn't prepare ahead of time. With that said, sould I let it fly or have it nullified? I been walking with a gait favoring that knee since I hurt it in 76' and still walk with one since my TKR. That's one of the reasons I'm 60%. My knee still buckles. and flexation isn't so great. The pain is awful! I have a history of neck, back. arms,legs and feet problems. Should I add these to my reconsider notice as secondary to my knee and let it fly? Like I said, time is running out. If anyone needs more info please let me know! Like alot of other folks, funds are depleteing fast!

    Have you talked with a Voc Rehab counselor about your unemployable issues, i.e. sitting for more that 15 minutes, etc. etc.? IMHO, I would have them write a letter stating that employment would not be possible with your current SC condition(s)? If you can get that letter, submit that as NEW evidence for TDIU, as soon as possible.

    Also, if you can, having an Occupational Therapist conduct a Physical Limitation test (push, pull, etc.) is another way to show that you are not physically able to work. Then submit those results as NEW evidence!!

  4. Holee moly I got approved for SSD, got letter yesterday. I am so relieved that I can get help with our (wife and I) finances. Happy I got it but yet sad that at 39 years old/young I am on ssd.

    An overwhelming emotional feeling.

    Thru VA Voc RehabI am going to college but I barely am able to do that; forget about working right now I'd be on a neverending break.

    Doing research, I can't find it but thought I read that if your approved for Social security disability for the condition of your VA disability that VA Disability is supposed to go up or you can get umm a temporary 100% disability rating? is that correct??

    Also, I remember reading that there is a ummm hardship thing to push the 100% disability faster? Correct??

    I will post my win on the win forum, my wife and I are so happy we have this. A win can take so long with the VA and it's the most stressful thing to deal with them and your disability at the same time.

    What is your current SC condtions from VA right now? Are you at 20% like your profile shows? Did you win SSDI with 20% SC or do you have other NSC conditions?

  5. I call the tech support number and they are "suppose" to send me a new logon ID number or something to that effect, to verify that it is me trying to log in via said letter! We shall see if I get anything in the mail. I called the beginning of last week, still nothing in the mailbox.

    Let the waiting games begin....................

  6. According to the E benefits site, you should be able to register for an account through your current MyHealthVet account. I've been trying for about a month now and all I get is an error message and that they are working on it.

    I'm in the same holding position, I check it regularly to see if I can gain access via MyHealthVet Logon. Still getting the "under maintenance" message......and it's been weeks since I started trying to gain access to Ebenefits.

  7. I was denied at the reconsideration level Im 100% tdiu sc, I got binder and binder to represent me, so what can I expect next from ssdi?

    drm65......I'm currently in your same situation.......I'm awaiting on a ALJ hearing myself. IMHO, once we get in front of a ALJ, we will have no problem getting a favorable decision! Well this is the way I see it, I'm 80%SC (all physical aliments, no MH issues) with TDIU!

    Given the veteran's service-connected disabilities and his testimony, the Board finds the evidence at least in relative equipoise. Although the evidence indicates that the veteran may be working at the delicatessen, such a family business and protected working environment reflects that of a marginal employment. In consideration of veteran's level of education and his prior work history in business administration, the Board does not consider his work at the delicatessen, if any, to be that of a substantially gainful employment.

    ORDERA TDIU is granted, subject to the law and regulations governing the payment of VA monetary benefits.

    In this instance - I am glad you are not a VBA adjudicator / decision maker.

    If so, you would be illegally denying claimants IU due to a personal judgement call, of your own making.

    I think argument can be made for attending college or classes -

    1) the claimant maybe limited to the amount of credit hours they are able to handle due to sc'd disability.

    2) the claimant maybe in need of special accommodations due to sc'd disability.

    3) the college classes maybe limited to on line due to sc'd disability.

    4) attending class does not meet the criteria of gainful employment.

    Interesting points! I think if you are attending college then TDIU would not be acceptable for the VA to grant it! JHMO!

  11. So confused! I've seen on the forums that while waiting for my rating, since I'm not working, that I should go ahead and apply for TDIU, as it hurts nothing. But I dug into too many specific and personal stories here on the forums and got myself confused. So this is all hypothetical...let's say that I met the medical criteria for these benefits at some point...here are my questions?

    1. Can I get approved for and receive TDIU while attending college?

    NO! You cannot be approved to TDIU, TDIU is for veterans unable to gain suitable employment due to their SC conditions! If you are attending college, why would the VA grant this benefit! Attending college would be grounds for a DENIAL!

    2. Can having TDIU keep you from getting P&T?

    NO! You can be TDIU and P&T!

    3. Can TDIU help raise you to 100% schedular?

    This is a mute point, if you are TDIU, then 100% schedular is possible but why if you are already being paid the 100% rate!

    4. Can TDIU help raise you to 100% P&T?

    5. Can you receive TDIU and P&T at the same time?

    YES!

    6. Can I get approved for and receive P&T while attending college?

    If you are only 100% schedular, not TDIU!

    7. Can I still work for a family business while receiving TDIU?

    NO! You need to read the TDIU criteria!

    8. Can I still work for a family business while receiving P&T?

    YES! Only if you are 100% schedular!

    I appreciate your answers to these questions. If I have more questions after that, I'll ask then. I just want to get these figured out first. Currently suffering from information overload, I do not mean to be rude.

    I tolerate oxycodne pretty well. Like you said no oxycontin from the VA due to cost. I did not know about the theft by VA employees. So the VA makes us suffer for their lack of security. My pain doctor told me oxycontin was too addictive but the fentanyl, morphine and methadone is not addictive I guess. I knew they were lying and there had to be another reason. In Florida the demon drug is now oxycodone. It is Satan's spawn according to the media. There are tons of backdoor clinics that will prescribe it on a cash and carry basis. No insurance accepted.

    I think the cash and carry doctors are hurting every american that needs pain meds. It's a shame that they still allow them to do this!

    From what I heard, Florida is the place to get pain meds!
