  1. So, my question is, should I request that my TDIU be made P & T? Should I ask for that on this initial TDIU claim, or make a separate request later?

IMHO, just shoot for being IU first, then wait and see if they approved it .......depending on your status......then file for P&T. You shouldn't worry about P&T at this point, just getting approved should be your only concern at this point!

Also, since the examiner indicates that I stopped working due to my SC condition, do you think I might have a shot at retro? If so, should I mention it as part of this initial TDIU claim or again, make a separate claim afterward?

The date you file for IU is the date they pay retro tooo. So the answer is NO! Make sure you send your letter certified to the VA!

    Good Luck!

  2. My doc thinks it will be good for me to still get out so my next thing I have to do is think of where to volunteer, she said you already get paid I think it would be good for you to find something and volunteer 20 hours a week. Im thinking OVH which is Ohio Veterans Home but I still dont know. I do want it to be something that is worthy or helping vets

IMHO, I would be careful of volunteering too much time.......the VA will see that you are capable of working thus resulting in your IU being taken away! I'm, personally, am afraid to do much of anything that looks like work......so they won't have the grounds to take my IU away! Just something to be aware of! Best of Luck!

  3. One of my claims is for depression. The depression is caused by illness, which was caused by illness on and after active duty, service connected.

I am rated at 50% for illness from Jet Fuel, on active duty.

I have claims in for more ilnesses, and also for depression. The depression is from the illnesses. I was never see for depression on active duty.

I just had two C&P exams for neurological issues, and for medical. I was never sent to an exam for spression for my claim.

But, I have been seen many times for depression at the VA for 15 years.

I just wondered why they never sent me for a C&P exam for depression. maybe they have enough evidence for the depression with more exams?

I expect the rating decisions soon.. as it's been a months now (C&P exams wre in July 2010).

Quick question, did you get a copy of your C&P exams to see if documented? Just a thought.......

  4. I may be wrong or off but I think they included it in your 30% rating. It States:" An evaluation of 30 percent is granted whenever there is malunion of the tibia and fibula with marked knee or ankle disability".

    Hope this Helps

I was thinking the same thing! But I'm going to file because I had the right ankle fracture in Aug 91, then had the Tib/Fib fracture (IM nailing) in Jul 99.

    Thanks again! Pete and LarryJ!

    All the best!

  5. It is not the government policy to stop use of a form just because it is not used. I am quite sure that they have printed so many copies of this new form that they will continue to use it for a long time to come. I think every veteran should use the best form that will help them win their claim. A veteran may feel that he/she has all the information the need to get awarded service connection but they may not and get a quick denial and then the long process of the appeal begins. it is how you look at it, but I would do what is best for me and not because they would stop using a form.

Did you get a chance to look at my attachment of my rated conditions. I don't see anything referring to my right ankle. Thus the reason I'm filing a claim.

    Thanks again!

  6. Looking through my SMR, I found the permanent profile (P3) for my right ankle from Aug 1993. The medical condition stated on the top of the form is "Traumatic Arthritis Right Ankle". I hope this will help the VARO in granting SC for my ankle. I guess it won't hurt!

Thanks LarryJ and CAS for the advice, as I truly appreciate it!

Now....to fill out the form......wish me luck!

  7. I'm already SC'd for other conditions but my right ankle was fractured while I was in and was never rated by the VA. I guess they overlooked it when I rec'd my initial rating back in 2001.

What form do I use to make a claim on my right ankle. I've when through my SMR and copied all related documents (33 pages) about my fractured right ankle.

I would like to do this claim myself as the local VSO is worthless!

I will be hand carrying this claim to my local VARO and getting it stamped!

    Thanks again!

  8. After 3 years of research and help from dozens of others, we have finally proven Allan Kofoid's service at Tan Son Nhut AB, Vietnam in 1966. The VA has granted service connection for his prostate cancer with 60% disability for residuals from the treatment. Thanks to everyone who responded to our cry for help and sent us in the right direction. Hopefully we can help others if need be.

Congrats on a great win! Good job!

    Best of Luck!
