"CNN will be airing a blistering report on the Department of Veterans Affairs and their total failure to meet their commitment to our disabled veterans. I urge everyone to tune-in to see how CNN handles this very sensitive subject. Also, tonight at 8PM on CNN is a Special on Homeless Veterans.

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

Buyer is an Indiana Congressman who is probably going to run for Senator Lugar's seat in the next election. I hope the Veteran's here in Indiana make the right choice for Lugar's Senate seat when he retires. I don't think Buyer is for cutting benefits. I think what buikx's post is saying is that Buyer is against cutting funding for one group of Veterans to give it to another. I think our World War II Filipino Veterans deserve their benefits, but we need to find a way to do it without taking from any other group of Veterans. That is where Full Mandatory Funding could help if we could come up with a way to have more oversight of what the VA does with their funding.

I'd like to see members on this board call his office and ask about this if they have concerns about what Congressman Buyer's oppinion is and give his staff their oppinion. Call his Washington office (202) 225-5037.

I hope Indiana Veterans put Buyer in the unemployment line. He's all about short changing Vet's. Taking a stand on this one issue does not make his prior poor record go away.

The only reason he did it is cause he does not have that many Filapino Veterans in his District. By the way that problem is being solved as they die every day. For the life of me I do not understand how the VA can screw them over like they do.

Buyer is against almost anything done to repair damage he has done to Veterans. By the way I may be confusing him with Nicholson but I recall he was a Lawyer in the Army. I really think that his chances are poor to win the Senate in Indiana.

Veterans deserve real choice for their health care.

The VA was paying benefits to Filipino disabled vets in the late 40s and early 50s then stopped and has been screwing them ever since, now they want to start the payments again good for them and the vets in the Philipinnes will get less than Philipine vets living in the US because of the monetary differences this is just more of Buyers scare tactics Buyer does nothing to help veterans and everything that comes out of his mouth has to be met with skepticism and his Bronze Star was not for valor it was for being a lawyer I know supply sergeants that got Bronze stars for having toilet paper Mess sergeants for providing hot meals etc there still aren't any Vs on them for valor

Reading the different posts on this website has made me realized that things have to change for veterans. You may not agree with me , but it may be time that all veterans unite. What I mean is veterans should consider going to Washington , D.C. on a particular designated date. There they can present to Congress their displeasures with the current VA system handling of claims and providing health care. If a veteran is not able to go to Washington on the designated date then they should go to their local Congressman's or Senator's office. Other groups have united to bring forth their concerns to government, why not veterans? It would take a united effort and the organizational skills of many people. It is only my opinion of what veterans could do. I hope you all don't consider this too radical and if you do, please don't me tear me apart. Thanks.

Mustang:

When I first started going to the VA there were 27 Million Veterans. Now there are 17 Million. Even an idiot at the VA has to figure out that the numbers are going down. Less numbers would mean that they would have more money for those left but what we have now will see it as an opportunity to cut dollars spent on Veterans.

Veterans deserve real choice for their health care.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
