Hearing Loss

I just got the copy of my complete c-file and health records from the RO. In it was my request for hearing loss from 1983 it also had my one sentence denial letter. After reviewing my health records they appear to show that I infact did have some hearing loss start while I was in service but the statement "satisfactory for VA purposes" anyone ever heard of that? Also I am now having a very hard time hearing or should I say understanding even with my aids. I was wondering if I should take these records in and have my VA audiologist that I have now go over them and see what they say? I would really like to reopen this claim because I do believe that this really started while i was in service.

definately reopen it! They did the same exact thing to me...SMR's showed a hearing loss from entry to ETS, then VA denied right ear because I didn't have hearing loss per their standards. According to the reg, which changed 6 months before I ETS'd, they should have SC'd my right ear at 0% because there was a definate change in my right ear hearing that is evidenced in the SMR's. They SC'd my left ear in 1994. I just put in to reopen, and I have found several BVA cases where the RO screwed vets over in the exact same way, only to be reversed by the BVA. I included 2 of those cases with my evidence to reopen. Good luck!

MY claim is open (since 1970)service connected 0%- VA has supplied hearing aids (ite) in the ear aids .I had a test at the VA last year for the claim and it said my word discrimation was 100% in each ear. So I just had the test re done at my medical center and-----it rates at-- 10% on the VA CHART- so this is fixing to goback in -and also the hearing specialist said the ITE aids werent capeable of fixing my hearing problem-I NEEDED OTE outside the ear aids with more power (less squealing)for the hearing loss.

So if you can get an independent TEST done -DO IT=

YOU CAN ALSO get an INFRA RED HEARING SYSTEM with WIRELESS

HEADPHONES for your TV FROM MOST VA HOSPITALS for your

hearing loss (BECAUSE AS THE WIFE TOLD THEM) I DONT

HAVE TO GO DEAF BECAUSE HE CANT HEAR.

NOW MY VA FEE BASIS WANTS ME TO SEND THE BILLING TO THEM ?????

I WONT HOLD MY BREATH=== I LET THEM PAY THE $26,000 BILL AT THE

NON VA HOSPITAL LAST YEAR== GOOD LUCK ALL ====STEVE

In 1984 when the VA tested me the test sheet said Bilateral sensorineural hearing loss, mild to severe on the right side and mild to moderate on the left.

My separation exam says "hearing loss unilateral high frequency" dated Oct. 14, 1971

Just found the rateing decision form #21-6796 it says:

SMR shows normal audiogram on preinduction PE. SMR is silent for complaint of hearing loss. SMR shows normal audiogram on seperation PE.

VAE shows mild to severe HFHL on the right and mild to moderate on the left.

Evidence of record shows that no hearing loss occurred during service.

6292 NSC VE Bilateral hearing loss.

not sure what this all means but my separation exam clearly states that I have a high frequency haring loss and it is dated oct. 14,1970.

I have tried twice for Tinnitus and turned down. I might try again so I can get the disability waiver on life insurance as the VA now has given me a hearing aid.

How can they turn you down for Tinnitus. They gave it to me without even clamiing it. I put in for High Frequency hearing loss. The QTC Doc asked me about rining in my ears. I told her 2 to 3 times per week. Next thing you know disproved for hearing loss. Not bad enough I guess and approved for Tinnitus.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
