First I want to apolagize for dropping off and not keeping in touch.

I have been sick for the most part of the past few months. As I type this I am fighting a cold, sometimes thats all it takes to knock me down these days.

For those who might not know, I was given a grant of SC as Secondary to my DMII earlier this year with an effective date of 2005 (When I originally filed). But due to the VA listing my Heart Disease as "Aggravated By" instead of "Caused / Secondary" to my DMII I was given a rating of 0%.

I received my decision today on the NOD for my Heart Disease Secondary To DMII.

I was granted 100% Effective 2005 for my Heart Disease as "Secondary to" my DMII. I also was awarded SMC Housebound from 2007.

It has been a long road to get here, and I still have more to fight with the VA, but it feels good to put one in the win column for a change.

I absolutely must thank HADIT ( Thank You TBird) and all the caring members for this win. Without Hadit I seriously doubt I would be typing this post. Thank you to all those that read, posted, and replied to my posts.

To go beyound that, I feel that I must mention a few people that I feel I can never thank enough for all their assitance and support.

Carlie, CowGirl, Josephine, and Berta for all your support and thoughts.

Morgan and Dr. Bash for all the time spent assisting me in putting everything together. Morgan spend endless hours assiting me for quite some time, she took time from her life to make sure I had everything I needed to fight and do well at my hearing. Dr. Bash took the time and effort to put together an opinion that I would say is a piece of art.

I will do my best to check in until I get better, then I hope to spend more time contributing again.

Don, I'm speechless and celebrating you ! Oh my word, Glory be - you did it. You got whats due and certainly you dont need to apologize for not keeping in touch. You are really 'in touch' now!

God is so good, do continue to take care of yourself and that wonderful family of yours. Take some time off the 'battle' for benefits and enjoy the fruits of your labor.

Have someone along with you, check, recheck the dates and payments for accuracy!!

Congrats!!!!!

This is good news. The VA must have some money that they have not spent this fiscal year. Usually when they start their new year they award a lot of claims.

I used to attend a VVA meeting once a month and in November at the meeting 7 of us had just been awarded 100%.

So those that are waiting this is a good time of year cause the awards will fall like rain.

Every win is a victory for us all.

Thank you and I hope that you get to feeling better. Nothing worse than a cold as far as I am concerned.

Veterans deserve real choice for their health care.

Yes a decision can turn around with a solid NOD!!!!!!!

The NOD ,after the VCAA election response, is the first most important response we all have after a claim is denied.

A generic NOD ,written by a vet rep indtead of the vet themselves- that does not really disagree with the decision in detail,- assures the claim will probably be denied again- or at least-set up for a long battle for the veteran-in many many cases.

You did GREAT and these are ALL wonderful advocates that you named here-who helped you.

I hope you feel better soon and hang in here at hadit- you have much to share and can give vets who are waiting -the support and hope they need to hang in there!!!!!

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
