Got snail mail form letter still workin on your claim' and a long, very nice Iris response 'claim is rated'

Iris response, in summary ...'last step could take 2 - 4 weeks; or longer if complex. no need for me to do anything

I may be anxious but mostly curious if this reply is standard issue or not.

Time will tell, crossing my fingers.

I predict that the closer our new VA Secretary is to looking at VA the quicker the pace will pick up. In other words I suspect that it will be less than 2 months. I did hear the General say that if the entrenched VA Bureaucrats did not want to change that they could change jobs.

Has anyone thought that they can get rid of people just by using the old layoff scenario

Wow i hope your right on the moving faster...

The layoff thing there would be tough because of all them rules that are in place for Feds so they can keep them jobs. Maybe just maybe they will redo things for the boys and girls serving and coming home.... maybe hadit needs to come up with a better way and send it to Obama,s Blackberry..

I agree with Tyler. If I remember correctly you've been in the claims proccess for some time. If an awarded claim/s includes retro pay over $25,000 a "second signature" is required. Mine took a couple of weeks.

Rentalguy found out his rating from a VAMC doctor. Maybe call your local VAMC and ask for your rating.

Best of luck

Paul

I did an Iris inquiry about my CUE claim. I had a hearing over 6 months ago. I made the inquiry a month ago. I got a response saying the VA is still working on the resonse to my Iris. They cannot even tell me the status of my CUE much less tell me when it will be decided. This is a legal issue. There is no development required. It would be a very large retro if I win. Being the pessimist that I am I doubt I will win at the VARO where the error occurred. If I lose at the VARO I am wondering if my lawyer will want to go forward with an appeal to the BVA and then the Court. He is the one who flew from New Jersey to represent me at my hearing, so he must think I have a case. The thing is how much more will he want to put into it if we lose at the VARO. I think we will lose becasue of the money involved (at least 20 years of retro and maybe 30 years if it falls right). I think they will try and wait me out in hopes I will die before I can collect, or get to the final appeal.

John, sounds like your claim has been in awhile too. I have a good feelng yours will get resolved in your favor, just hard to know the when? Have you followed up with a new Iris this is a new year? Along with the iris, is it possible to add other addresses that want to know claim status? Lawyer, politician? Email or snail mail addresses, could be an indication you have fire power with ya. Just a thought. Add some sugar, seems to be what I was sent from the Iris regional center ( thanking me for contacting them, service to my country, feel free to contact us ....etc).

Pete, time, hurry, rock and Purple (sounds like rock band!) Thanks for the thoughts and encouragement. I need the energy, husband has consult for surgery, is nervous, so as long as the rating is fairly stated to my favor, it'll be a reassuring distraction. You all are the best and I do thank God everyday for each of you Angels

(By the way, I grew up on a ranch in Colorado). Here is what I recommend: Go do "something else"...take up a hobby..even if it is playing chess or walking in the park..reading, etc..GET AWAY from your claim. Check your mail, but not at the second it comes. Relax.

Remember, that regardless of this decisions outcome, it isnt the end. (If you "win" your claim you will have some money for a while, but you will likely spend it, and then be "hoping" for a big Cola in a couple years. On the other hand, if you loose, its not the end, you can always appeal. So, either way, "enjoy the journey"...hmmm..maybe even oh, I dont know..start going to church or shovel old people's snow, like I did, today.

Your IRIS inquiry may or may not be accurate. I was promised an answer in "six to 8 weeks" by IRIS and it wound up being more than a year..for a denial. Of course, you could also be like some of the success stories and be awarded full benefits plus a free years supply of stickers for your envelopes by tommorrow. At any rate good luck.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
