The AMC gave me 30 days to send additional comments and/or evidence to their Rating Decision (denial). I had written a 5 page "Rebuttal", but decided instead, that I'd sooner send a formal Notice of Disagreement (NOD). SO I changed the subjject from Rebuttal to NOD ...

At the US Post Office, I sent 2, letter sized envelopes (pre-made by the USPS).

The first copy I addressed to the AMC; the second copy to the BVA.

I paid for both: Prioroty Mail and Certified mail, which was supposed to get there in 2-3 days! It's been 8 days, and counting!

I'm really glad I decided to send the NOD, rather than the rebuttal, because the 30 day limitation was up as of yesterday!

Now the question: what are the VA Regulations on filing deadlines or statute of limitations? If I have proof of mailing within that time frame, does it count? What if the Post Office doesn't get my package there on time, but I have proof I mailed early???? ~Wings

I've got the answer for the future.

It is called gps tracking. Yes that is right. We have our letter/documents sealed in an envelope than placed it in a gps "special" envelope that tracks the letter/document all the time and all it's whereabouts from when we mail it to it's destination. Not only does it track this it also has the capability of following the proper channels it is suppose to follow. Therefore when SOMEONE tries to hide it, discard it or the infamous shredding, it would just explode the outer envelope only, thereby putting a permanant ink mark on the perpertrator!(It would not cause any physical harm, just ink them all over!) BINGO, no more shafting vets mail.

The banks do it with money tracking, so why hasn't someone explored this option with our mailings?

In a perfect world, there would be honest people, they would care for those in need,...WHERE WHEN HOW WHAT????

When I sent my NOD 2/12 (for the second time), I paid $17.50 for "Express Delivery".

I also SIGNED my name next to the check box that specifically provides that they NOT ATTEMPT WEEKEND DELIVERY.

They were supposed to HOLD DELIVERY ATTEMPT until Tuesday, 2/27.

All this information is very clear on the express mail slip.

Today, I get an update (mind you, the first 2 packages sent 2/4 are still AWOL) . . .

I guess they don't read either. But for the price you paid - they SHOULD read it.

I am beginning to think that mail stands a better chance of being delivered properly with just a stamp.

My mailman brought a package to my door Saturday. When I left home Sunday, I noticed the flag still up on my mailbox. The mail I was sending was still in there. Well dang... I would have run it by the Post Office if I knew he wasn't going to pick it up.

Whew- I was getting as concerned as you were Wings- and I agree with Free- that snail mail seems to be Faster than Priority these days-

Thanks for your kind offer re a hearing Wings--it isnt the money-and I might consider asking for a hearing-

if my new tactical battlefield plan doesnt work---

just that if I have to get on a plane again (I used to love to travel but dont like it anymore)

I would rather go to Vietnam than go anywhere else or specially anywhere that does not involve the VA.

Ice fishing in Anckorage Alaska would be a nice trip too.

Or even just watching the Travel Channel if I have a good stack of brownies around.

Just kidding- I sure know how upsetting it can be to make sure the VA actually got priority mail.

And of course this stuff alway seems to happen too- when there is a three day weekend

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
