Within hours after receipt of my evidence the AMC remanded the claim back to the BVA_ and never satiisfied the Sept remand conditions.

AGAIN my IMOS and other evidence remain unread and unacknowledged at all.Claim filed 6 YEARS ago.

I filed formal complaint but got the internal phone numbers to make waves too-

If the AMC is only a go between and remand back to the BVA what they do not work on- why are the tax payers paying salaries for the AMC raters?

I feel this was definitely retaliation for my testimony before the H VAC last week.

CBS wanted me to go on the Couric show the next night after the hearing- I wonder what the VA did to the widow and Iraq vet who were able to be on the show.

The dumb bastards- they even paid for me to go to a war college-

I will sure use those maneuver warfare tactics I learned to get this paper battle over once and for all.

They are continuing to disregard (and probably destroy) evidence!

I am so sorry.

The sad thing these people are not dumb, they are very intelligent and they play games.

Why in the world can't these people be fired by someone and the system started again.

There is NO DOUBT that this is a retaliatory effort. The VA retaliated on me, too, because I filed a Writ of Mandamus, after the VA "forgot" to take ANY action on my 2004 NOD. In the Secretary's response to my writ, the RO manager stated that my NOD was "interpreted as a claim for benefits". They were "blowing smoke" and I am calling them on it..there was no evidence to support their statement.

The VA HATES outspoken Veterans Advocates, and uses the system to manipulate us to "Shut up" other Veteran complaints.

Like you, I will not shut up, and I applaud YOU for sticking up for us. The VA wants you to tell others, "Now, now, dont complain about the VA or you will loose your benefits..or never get them"

They used this manipulation in boot camp..because it works.

We went into a smoke filled chamber. It was a concrete building..with a carefully controlled smoking fire. WE had to put the fire out.

We all had to do it. We had a hose..each man hung onto the firehose. One man turned on the water to put out the fire, but they didnt let us have any water in the hose for about 60 seconds. The smoke enters your lungs..you feel the heat. It is the scariest feeling I have ever experienced. They tell you that you MUST remain calm and breathe through your nose.

One man panicked, started breathing through his mouth and choked on the smoke..and ran out of the building in a panic. We all felt like doing the same..we were all scared..have you ever been in a burning building?

Then they make EVERY man do it again. Not just the guy who panicked, but EVERYone...because one panicked. WE all got hold of the panicker (fortunately it was not me!) and told him that if he panicked again..we would beat the crap out of him and send his bones to his mother..and we meant it, because it is very very scary.

The pressure from all of us worked, and we completed it either the second or third try.

This is exactly what the VA is doing to you. By retaliating against you, they are pressuring the rest of us to keep breathing the smoke the VA blows up our buts and not panic. Its the military way. Dont give in to them. I am standing here beside you and I wont let the VA do that to you either. I am with you!

Do you still have a contact number for CBS ?

Call them - do an interview - squeak - get grease -

VA will adjudicate quickly to shut you up -get your benefits -

put your VA paperwork away.

Anyone who advocates for veterans can expect the VA to retaliate.

Berta is living proof.

Never give up Berta. It is because of your dedication to fight the VA that I cintinue in my battle.

Berta, this is paperwork shuffle and ignorance on their part. We all know that here. What can we do to help you? Stay with it and like Carlie says, stay 'vocal', you are only trying to get whats due you. nothing more or less. All I can guess, you must have them very scared, very.

I don't know where ethics have gone to, but you deserve to be heard. Don't civilians have protected freedom of speech without retaliation.

Go gettem Berta. :D I am planning a little trip to the newspaper in the next couple of months, just getting my ducks in a role. I will play thier game with thier rules and hopefully stick it too them.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
