Question

it just seem to me there are a lot of us vet on this site wait for transcipt. or a decision i believe these hearing are cost us time if u go informal does that mean its not tape and a decsion can be made or is just part of there game. and who does these transcipt are they all done one place. if so goto school to be court typer because the va will be looking for these lol

I am completely convinced that I have had negative responses

to my claims due to:

1) St.pete VARO sucks

2) I filed and won a FTCA against Bay Pines VAMC

and my C-file contains a full copy of it.

3) It is in my records and C-file that I stalked a VAMC - ENT Doctor

on their Federal Property with a loaded weapon. In fact just the

other day I met a buddy over at St. Pete RO and saw this information

listed on the Capri screen.

I am patiently awaiting DeNovo review which is now just passed one year wait. I thought this might be quicker than the DRO Hearing. Now, I wonder if I would get better results by banging my head with a garbage can lid? May be I will suggest they change the DeNovo Review to "NO-NO" Review. Here goes: "Bang", now I feel much better and I will return to my line of patient vets awaiting a "timely" review.

You might consider a Writ of Mandamus if you have to wait much longer. Or you could write the Review Officer and tell them you would like to know when you will get an answer cause you are fixin to A get a Writ of Mandamus or B Hire a Lawyer or maybe both

Veterans deserve real choice for their health care.

Carlie, OMG I can't believe you did that!! I was trying to imply they put something bogus in your file[. Why is that keep coming up? Are they trying to alert all staff "be leary of this vet?" I am sorry if this did occur with you, and more so that others are made aware of it...I am sure it was related to a "breaking point!"

I have felt like screaming and cursing at the va staff,and VARO staff but maintained myself. I don't know how, but was afraid of getting arrested, Am very claustrophic to the max. I would have a heart attack if someone tried to hand cuff me. Don't want to go off on a tangent on this post but having to dael with the further incompetence of raters, dro,va it could be a boiling point.

They can put an "FLAG" on you file, but it takes a very clear process to do so. The problem is, while the may not be able to "flag" your file with an alert - they can add notes and often do. I had one left in all caps stating I was dangerous and the clinic was afraid to treat me because of my size and hostility. This all from one phone call asking for them to properly refill my meds (since they had screwed them up).

The LPN who left that note quit 6 months later, but its still in my records - in all caps. However my file has not been flagged, I checked that personally during a visit. Oh and my hostility ... I told her to shut up and go ask the doctor about the dosages. This after 10 minutes of trying to tell her this certain med had been prescribed for over 2 years at the same dosage rate....

(sigh)

And yet... more often than not - I am very satisified with the care I get. Yet I really think that just depends on where you live.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
