Champva Strikes Again

Rate this question

Question

Many weeks ago, I was told my ChampVA that my son's oral surgery would be covered because it wasn't a dental procedure...it was a medical procedure. He had to have a bone graft. Sounds simple right?

LMFAO.

Just got the EOB today. Claim DENIED. $857.00

Their reason? "Required preauthoization was not obtained"

The phone call tomorrow will be beyond ugly folks.

We are here to help. As they often say. Let them have it Purple.

A New Spoanis word comes to mind. It is SI Mon Pronoinced (see moan) which means "yeah right".

I go round and round with them also.

I record every pohone conversation and play it back to type it out so I can have a record.

Narrator is a great tool.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

I noticed they spend alot of time on mail (CHAMPVA)

I got what seems to be a bill on a biopsy I had done.I am not used to CHAMPVA stuff and wondered why my Medicare didnt pay it instead.

Then I got a notice from CHAMPVA a few days later that looks like they paid it.(Maybe Medicare did)

I wonder how much mail I will get on another biopsy they did?

These were only skin biopsys-minor stuff but my docs are very concerned about potential skin cancers.I think all docs should be.

ChampVA waits till Medicare pays and than pays fairly quickly. By law Medicare and ChampVA are all that can be charged unless you have not met your copays.

Thanks Pete -now I get that-

Question- I have never had a prescription until recently (except for antibiotics)

I am thank God always in great health.

I get this prescription refilled at TOPs where I food shop and they use my CHAMPVA for the payment.

The receipt says CHAMPVA co pay 25 % but I always get charges for about 50 % of the med's price.

Do I have some sort of annual prescription deductible I have to meet before I get the 25% co pay fee?

I tried to read the CHAMPVA booklet but I am so involved in VAOLA in different ways that I cannot seem to comprehend what the booklet says.

Last time I called CHAMPVA (which I hesitate to do) they checked with the RO for some reason and the &^%$ing VARO told them I WASNT eligible for CHAMPVA at all.

After 3 weeks of raising hell that was sure squared away-I have been eligible with award letter since 1991 for CHAMPVA.

I might have to pay for the second biopsy myself-

the docs had always said not to worry about a cyst on my back.

After my other doc got worried about a cyst on my hand, I had the back cyst removed too

I think maybe they would consider this a cosmetic surgery-dont know for sure.

I told the doc who removed it that it didnt hurt a bit and now I can chase men again with that ugly cyst gone.

Gosh I was kidding-hope he didnt put that in my med recs.

I also told him I liked him so much maybe I could find something else he could cut off.

Gee-hope THAT isnt in my records either.

Berta:

Although you are required to pay 25% copay your first prescriptions are charged full price till your 50 dollar deductible is made. In other words the pharmacy collects your deductible but never more than full price for the med. Once your deductible is met you should be at 25%.

Always check to make sure that the pharmacy has charged insurance. SOmetimes they don't. My pharmacy has a box with a Y in it if Insurance was charged.

Veterans deserve real choice for their health care.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
