It Is Finally Over Bva Granted My Appeal

for all of you regulars you know what I have been fighting and how long I have been fighting it. I got the letter from the BVA today they granted my appeal on Hypertension and Coronary Artery Disease secondary to PTSD.

They took exception to note that Dr Boscarino's study warranted inclusion the the Federal register, and also my IMO from DR James Ketchum the retired Colonel from Edgewood Arsenal and the Judge noted that I had been a test subject at Edgewood and that DR Ketchum accepted DR Boscarino's study as being a logical scientific study and that it was more plausible than my exposures to chemicals and drugs during the Cold War human experimentation.

Since my PTSD was awarded back to Dec 2003 and I started the claim on my heart disease in Nov 2002 I am sure they will only give me back pay to Dec 2003

but I am happy now if I have a heart attack and die they hace to give my wife and son benefits. YES

100% SC P&T PTSD 100% CAD 10% Hypertension and A&A = SMC L, SSD

Praise God !! Congratulations !! I would love to see research in support of your claim. I'm sure you'll be able to help your brother's whom have suffered the same fate. WOW, you fought long and hard, you must be exhaused --and happy. Thanks for being our friend here, all these years. ~Wings

Curious, if you handled it yourself or w/ VSO or lawyer? I have a pending "Request for Reconsideration-Disagreement" for my HTN claim. I have 60 days to reply whether I will request for DRO or Standard Appeal process. Been doing it myself since AO initial claim few years back & Reopen claims, etc.

I wanted to win this one so bad as VA is not doing it correct or overlooking it..Congrats again!

I had to hire a lawyer they were really messing with me because of the Edgewood experiments and I hired her in 2007 right after they made it legal and when we got the first NOD after that she went to work. I got her name from Larry Scott at VA watchdog he hadmet her at one of the NOVA conferences. Bottom line it was the links to DR Boascarino's studies that the doctors that wrote my IMO's all pointed to that the BVA Judge noted in his decision. Good luck on your appeal but it is my experience that a RO will not award heart problems secondary to PTSD and you have to appeal to the BVA.
