Question

Hello I am SC for a back Injury that has resulted in my present condition of DDD. Here is the lick My back is shot. L5S1 has had the surgery 2-3 years ago now the disc is trash (per MRI ordered by VA) Now I need to know since the VA glossed over the fact when I put in for IU that even though I put the most recent MRI and the One two years ago showing the progression of the disease. How can I find out if my condition should have been rated under another DIagnostic code by the C/P Examiner failed to do once again? Not being a Doctor or a lawyer I tend to ask people I trust. I think in my mind I was low balled but hey it is just my opinon. I do know I hurt all the time have back spasms and sleep is usally during the day after all night up and down. What sucks is the fact I have no quality of life right now to the point that I am considering surgery again for the second time. Any thoughts holler at me off line if you will with your thoughts on back surgery. I can barley bend over at the waist as it starts to hurt like hell and I have to have help to even get dressed. If I do not get someone to put my clothes on before they leave it is flip flops for the day. I am kind of going through some major depresson right now my kids are little and come up to me asking questions like " Why cant you play with me like other parents do" That hurts more than the actual pain but again they expect me to be Dad so it goes with the teritory. Have a good day

We kept our promise and served honorably. Now it is time for the VA to keep their's!

I am not an attorney or VSO and offer my opinions free of charge. Any advice I provide in my posts is from experiences I have had with the VA or I have the knowledge that others have encoutered. I accept no liability for this advice should you chose to follow it.

What are you rated at now for your back?? ROM is the key unless you are SC for IVDS then it is periods of incapacitation. I always wonder about the diagnostic codes too. I think you can request to be reclassified and give them the code you are looking for. Have you been hospitalized in the past year for your back? Your depression seems like it may be worsening also.

I am rated at 10% for DDD. I belive I should have been rated at on a different diganosis with the way my back has fallen apart. I know the ROM is way differnt now than then. Thanks ans I am seeing a new Doctor for Dperession tommorow. I could deal with some of the problems but constant pain all the time will drive you nuts. I was hospitalized a couple of years ago for lamenctomy but nothing here lately. I have been told I am going to a Nuerosurgeon but I can tell you this I am no big fan of surgery. Adios and thanks for your advice........

Oldman, did or do you have another physician that can confirm your back 'diagnosis' for the timeframe that va sc you? Do you have a copy of your Cfile, VA medical file and what each says? There may be clues there, along with the c&p exam note in specific. Use the exam worksheet as a guide and research - research some more.

If you put in for an increase for sc issue, the ball gets rolling again.

Honestly, my exam for iu found a sc issue and clarified the diagnosis. I was surprised to recieve year or so of backpay for that increase. Then, I read and reread, asked questions, then sure enough, got eed for same back to original sc date (discharge!)!

Let us know where you are at from time to time.

Er, oldman, kids are more resilient than we think and creative - heck, why can't those parents play the way you do?? ha. back at em. Bet you're awesome at video games.

Cg'up2009!

For my children, my God sent husband and my Hadit family of veterans, I carry on.

God Bless A m e r i c a, Her Veterans and their Families!

oldman,

You posted,

"Thanks ans I am seeing a new Doctor for Dperession tommorow. I could deal with some of the problems but constant pain all the time will drive you nuts."

If your depression is directly related to your pain and your pain is directly related to

service connected disability -- be SURE to have the mental health doctor document this.

jmho,

carlie

Carlie passed away in November 2015 she is missed.

You may end up getting a much higher rating as depression secondary to a SC disorder than the disorder itself! Everyone with chronic pain is depressed just about I think.

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
    • Welcome to hadit!

There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

      https://www.va.gov/resources/getting-emergency-care-at-non-va-facilities/

However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.

When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.

However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.

That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.

Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.

Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

      https://www.law.cornell.edu/cfr/text/38/3.344

    • Good question.

Maybe I can clear it up.

The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      More here:

      Source:

      https://www.va.gov/disability/dependency-indemnity-compensation/

NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
