Who Has Actually Done A Reconsideration, What Was The Outcome And How Long Did It Take?

Question

I just wanted to get an approximate timeframe in mind to relax my soul due to a Reconsideration I submitted. :unsure: I just wanted to know, who actually has submitted one, what was the outcome and how long did it take? Keep in mind, I am still in my first 12 months after retirement. I submitted under the BDD Program. I retired Nov 2008 and my rating was finalized on 16 March. I submitted the Reconsideration on 14 April. Thanks, for reading.

Are you saying that

1) you submitted a claim to your VARO

2) you Disagreed with something in their decision

3) you filed a NOD

4) you Requested Reconsideration from the VARO ?

If the answer to # 4 is yes -

did you submit any New and Material Evidence with the Request for Reconsideration ?

Yes, I requested Reconsideration due to new evidence. Is VARO my Veterans Affiars Regional Office? If so, then yes, I did (through my AMVET rep).

Why, do you have more info for me? :unsure:

They can string out these Reconsideration Requests-hoping the NOD will not be filed in timely manner so they can deny and you lose appellate rights.

I filed one in 2006 on a 2004 decision on 2 CUE claims.By 2006 they acknowledged it but the letter I received was ludicrous so I asked for DRO review-

I was able to file the NOD in the final week of the NOD year, and also within the lawyer for vets regs-the same week that became law June 2007.

I only had a lawyer for about 3 weeks-I was uncomfortable with their approach.So the reconsideration request was still pending for DRO review after almost 3 years since filing it.

My recent decision from the BVA has made the CUE claims moot issues and they will be awarded under a completely different scenario.

Since the BVA granted my main issues , all 6 other claims I have had at the VARO must be granted.

But as you can see they would not award the CUE even based on the reconsideration request-and were attempting to string it out longer.

If you have the support of your vet rep-however-your request might go much faster-

Thanks, for your reply, berta. I think under the BDD program I have certain privileges within my first year after retirement. You filed in 2006 for a 2004 decision. I am filing 5 months after retiring and one month after receiving my rating decision back. I think that makes a difference (atleast I hope). :unsure:

I filed a recon in 2003, after a denial for sc increase... received an answer back within 4 months...still denied. Filed NOD within specified time in 2004...still denied...filed form 9 (BVA Appeal) in Spetember 2005.

Just won entire claim back dated to 2003 for some portions and back dated to 2007 for other portions...that were on a appeal. But process has taken almost seven (7) years to get to this point.

So, I don't know what to tell you...it works for some and not for others of us. And, what sometimes looks like a sure win to us is not to VA. Best regards!

Just an update on reconsideration. I called my contact at the RO today.

I can now understand how things get really messed up. It took him several minutes to figure out where my claim was, and who had been working on it. He was very concerned that other reps had been working on it, and not him. It sounded like it got seriously sidetracked.

He called me back, he found my file, got my last duty to assist letter attached and it's headed to the rater.

Should have decision by end of the month. We'll see.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
