I use the ST Pete VARO. There is none worse, but everyone feels their VARO stinks. If you have the evidence you can win anywhere. It ain't easy but my long term plan for victory is use your local VAMC. Get all your evidence together. Get IMO's if you need them. Hand deliver your evidence to the VARO. Check on the VARO every few weeks to see if there is something missing. Wait.....the hard part. Evidence and persistence is what wins claims. Also, you can't assume the VA is not going to make gross errors in your claim that have to be fought. If you have the perfect claim don't assume your money is in the bank.

Thank you for all the information

I have a adequate and complete claim. I have follow the advice of Hadit to the letter.

I had a weak C&P examiner, you could tell this by the first question she asked.

In my opinion she wrote what she wanted to hear, not what was said.

Anyway, I can't dwell on the negative, its not healthy

The way it worked for me was I would get these ratings and SOC's. The SOC contains the clues to getting a higher rating. I would address the SOC with a private doctor and rebut them. I did not get the rating I wanted the first time. Each appeal got me closer to the goal. Most don't get the rating they deserve the first time. You need the full court press to get there. PTSD and all mental claims are subjective. Your just surround them with evidence until there is no way for the VA to go but to grant you what you are after. Berta says this often. If you get service connected the first time you are in the ball park, and all things are possible. I started at 10%. Now I am 90% IU. What a long, strange trip it has been.

Boy oh Boy, WoW! Buddy I can say with out a dout you have to come correct the first time because Indy will try to suck the like out of you. rental, John999 are right on, but I can trully say if there is a way, hell they dont need away they will try to deny your claim so make sure your ducks are in a row and your watchin them at all times. You can WIN but you will have a lot of sleepless nights and constantly fighting to cut them off from them pulling tricks of there trade.... I could have never done it without the help here but non the less watch your claim and document stamp EVERYTHING! good luck yogg....

I am taking in all this advice, and I can see that it will be a uphill battle

I waited forty years to get involved, and it has been as stressful as anything I have done since RVN

On 6/2/2009, I began my journey, and the mentl health care is helping, but their documentation is confusing. Don't want to get off track. I already feel like I have three strikes, and I have not got the first rating.

Hang in there with your claim. My VARO is Indianapolis and I have had some decent luck. I filled for a claim a year ago. I expected at least 50% disability no problem. I was denied on several claims from my exposure to sodium dichromate in Iraq, which was and is big news. I was given high ratings for my other claims. I ended up 80% and I am still fighting for the main claims. I had every shred of evidence from the exposure and was denied. I am currently going thru the nod and just finished a few more c&p exams. I actually got a doctor instead of the nurse practioner. The Doctor couldn't understand why I was denied. He has written up a very favorable exam. He told me that the way the VA requested info from him, they are going to grant my request they just want to know how bad the problems are for a % rating. This doctor at Louisville KY VAMC was unbeleivable. He is very, very pro veteran. He is tired of how we are treated and rated. If you are in the Louisville VAMC and have a C&P exam ask to see Dr. Spanbauer. He is very intelligent and knows if you are trying to pull the wool or are lagite. I wish all my visits were this comfortable and helpful. Good Luck. PM me if you need any help! I would be glad to help.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
