Question

Well guy's..

My Father did 26 years Army and my Brother did 24 years Air Force and they are both mad at me. They both say that I make more than they did for having done less. I try to calmly explain to them both that I'd rather have my legs back, and be able to go out and play with my grad kids. They both know full well that it took over twenty years to even get the VA give me medical attention let along award me 100% P/T.

What gets me is they were the same ones screaming at me to get a job when I could not work because I was in severe pain.

Now you guys see why I really dont have a lot of faith in people that I dont know, if the people that I've known all my life act this way what can I really expect... HUH... You would think that they would say OK we were wrong and we now really know that something was wrong with you for the last twenty years. HA...

I have actual medical evidence backed up by the VA this time and they are still of the opinion that I just dont deserve it... I cant win...

Bigvic 100% P/T Severe Spinal Canal Stenosis....

They dont even realize that they were actually helping the VA further my deseased spinal column and medical condition which has led to my paralysis. B)

Sometimes family will treat us worse than strangers.

If your dad or brother had service related medical problems --

they'd be doing themselves an injustice by NOT filing a claim.

OMO,

BigVic:

I doubt that they are mad at you but they are mad at the government. One piece of advice is not to tell people how much VA pays you. Don't forget that disability is supposed to replace an income that you should have been able to earn.

Veterans deserve real choice for their health care.

Sometimes it's hard to remember that no one is obligated to subject themselves to abuse just because the abuser is family. We let our guard down because we expect them to support us, not damage us. You don't owe them access to you for the sheer opportunity of hurting your feelings and possibly making your physical condition worse. You've suffered losses and you've paid some high prices for your service, and you owe no one an explanation, nor do you need to provide yourself as a target of their anger over money.

With that many years in service, it's clear they are not intellectually challenged, so from the sound of it, this is a personal choice they've both made to be angry at you out of jealousy over your disability awards. The advice you received to keep this information to yourself in the future is valuable, since we now see what can happen if you don't.

You are absolutly right, I was trying to go overboard trying to please them and was just saying thanks for the little support I did get in the past. It's not like they really wanted to help me you know. You would think they'd be happy that I was out of their hair for support. I dont get it but I no longer care. Since I've been home they never visit or call me anyway. I spend most of my time by myself and in my condition theres not much I can do about that or how they feel. Oh well...

Dear Bigvic

IF they think you got such a good deal. Tell them to go through what you went through and you will give them your disablity pay. I dont think they will want to hurt themselfs and wait 20 years to collect.

I had not been home for 11 years. I went home with lettering on my truck back gate that told how crooked the VA is and had hadit.com website on it. My sisters first words to me in 11 years was the message on my truck made me look like I was a crazy mother f---er. She went on and on about it. There are allot of people in our socity who contribute and want abuse to be secret. My mom said she was jelous because I made more money then her and she had a masters degree in educaton which put her in debt.

I think part of it is. As we grew up. I was a goofy brother. I dont think she knows or could see the sacrafice and harm I went through in service to my country in the Army and through the VA system. When you grow up everday with someone. You can form ideas that there is no way my littel brother could do that or go through that.

In the end run. I feel proud of what I accomplished, It feels real good to come here on hadit and help veterans to laugh and get through the claims nightmare, So far the government has not slaped the goofyness out of me. I feel im being true to myself.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
    • Welcome to hadit!

There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

      https://www.va.gov/resources/getting-emergency-care-at-non-va-facilities/

However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.

When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.

However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.

That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.

Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.

Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:
