VA blamed our local PO for a medication mailing error years ago- but that was an impossible ploy they used that didnt work.

Every VA I think (certainly Bath VAMC here) has their own Post Office that mails the pharmacy meds.

When I raised a ruckus over their med error the pharmacy told me their inventory MUST be accurate daily and in those days I think t was.(but this was not inventory problem in my case)

If one has accessed VA Watchdog over the past year you can readilyu see that VA Pharmacy services are extremely deficent these days in any control over their inventories -which only sets the ground work for some VA employee at a VA Pharmacy or VA Post Office to swipe meds.

Osceola's response to his people, the Seminoles, was

simply "They(the US Army)have guns, but so do we."

Sameo to us -They (VA) have 38 CFR ,38 USC, and M21-1- but so do we.

I am sure that the VA Pharmacy gave the Veterans little or no help in getting the Meds that were stolen.

I tell them when my Meds go missing that the VA guarantees delivery so it does not matter why it just matters that they replace them quickly

As many know Meds by Mail suck

Veterans deserve real choice for their health care.

Prosecutor: Postal Worker Stole Veterans' Drugs

http://www.theindychannel.com/news/22315146/detail.html

This happened to me with Percocet, I reported it to the local post office. The postal inspector actually came to my house and took my statement. About 2-3 weeks later my meds were found. I have an employee whos husband is a manager at the main post office and she found out that the postal carrier was caught with mine and other peoples narcotic meds and was terminated and prosecuted.

VA sends my percoset and morphine by certified mail. I used to work for the USPS. Certified mail is handled just like ordinary mail except someone has to sign for it when, and if it ever gets delivered. I am sure the mailman knows what is in my envelope that comes once a month. The only mail that is really secure is registered mail. The VA would never use that because it is very expensive, and it has to be locked in a safe every night. My meds by mail has been pretty good. I am sure it varies by VAMC. You have good VARO's and you have horrible VARO's. That is what is wonderful about the VA. It is like a crap game. They play games and treat us like crap.

The Augusta GA and Charleston VA SC mail all regular prescrips by mail with scan codes on them but narcotics are all sent by fedEx and yes the fedex guy knows what he is delivering he annouces himself by stating my "pusher is here" Fed Ex got the federal contract on overnight mail back when 41 was President at a low low price of 4 dollars a package express mail was 7.95 and we could not lower it to "bid" on all of the governments over night mail business our prices were set by the Postal Commission and "deals" were not allowed 41 had the nerve to send a Fed Ex package with a letter to a NALC National convention to proclaim what a great job carriers were doing for the nation and how we saved many lives during the previous year because letter carriers notice when elderly people are not picking up their mail and call police or the kids to get help for the elderly we refused to open the letter because he sent it Fed Ex

The carrier that stole the drugs was one stupid he had no idea what kind of drugs was in the box unless the vet told him which was ignorant if he did but to throw away a 40,000 dollar a year job for some drugs was just plain stupid and now he is facing jail time besides losing his career I was a letter carrier and nothing in the mail was worth my job like I told my mom she was a clerk the only way I would steal anything from the Post Office is if it was like the Hope diamond and it would be worth the prison sentence and only if I would be able to keep it when I got out otherwise nothing in a package was worth my job and yes they did mail the Hope Diamond once back in the early 60s and it was sent insured regisitered mail I would have fired the clerk that accepted it for mailing and writing the insurance policy on it I use to have a bank delivery that required I carry a weapon issued to me by the Post Office and included 6 rounds of .38 ammo the bags contained nothing less than 2 million a day I later learned I was dropping off the Post Office deposits to the bank excuse me thats what Wells fargo does for a living.......

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
