Had C/p Today So Much Info To Go Through

Well had my C/P today my file was huge. I have IVDS and now am on the waiting list for Surgery (If I have it) was curious about some things come up need some advice. My left leg is noted by C/P Doctor to be showing atrophy due to my back (his words) and left leg is weaker than the right muscular leg. I could not harldy bend to the front or much to the right and left due to the pain. Leg raise was killing me even to raise them off the exma table. I was told that the fact that my IVDS is affecting my upper back with MRI findings and with numbness to both hands by the C/p Doc. I was informed that I needed to file a claim on it but do I wait on this claim to get done before I submit or do it now.

I am at 80% at the moment but I think that with the exam for I put in for IU on account of my SC back injury and the resulting decline of my back after two surgeries what do you guys think about the chance that my IU claim will go through as my the ROM and constant pain meds will do anything to help. I did make the point that the pain meds make me unable to drive when I take them but who knows if he writes everything I say down. Adios and have a good day up late with the back just thought I would chime in. Thanks for any ideas on what or when to file on this.

I think that you should get the TDIU

Veterans deserve real choice for their health care.

Well Pete thanks for the Vote but you know how the vote goes for us veterans sometimes. I am hoping that they lo9ok at the evidence I submited and not go through and cherry pick. Oh well at least I got a chance some people have nto got even that. Some guys whole records get lost. Adios and have a good weekend we are off to Charleston great for the kids bad for me I have to get out and stretch a good bit and pay for the ride the whole week ahead.

Looking good for tdiu, I would say my 8ball said favorable. Good luck.

Yes thanks they did use the gonimeter I probally made it about 3 inches to the left and about the same to the right and about 7 inches forward motion with pain at all directions. Shoot my wife was there with me and the C/P doc asked about yard work my wife gave him an earfull as she is the one who stays pissed off as I am about worthless other than being a spotter for when she ask if she got all the grass done. I piss her off when I tell her she missed here and there but we have a big yard. I have to at least do something LOL.. Hell I would give a months pay just to ride the lawn mower some myself as I had the thing tricked out with a shade cup holder and radio. I did mention about me falling as the left leg goes buck wild and stops working causing me to fall when I get brave and try walking around without the crutches.

I had put in for IU on account of my back had gone south on me and now am dependant on having someone to help me dress get around sometimes in the house. Rub that 8 ball and ask it about the surgery as I am on the fence was told 12 hours at least for the replacment of the four disch fusion and hardware. I have been shot at, cut with razors and fought like hell with crazy people but that one nuero surgeon scares me. I am just trying to get around the pain If you have any tricks that work for you let me know. Adios and I just want the claim looked at fairly would be refreshing for a change. Sorry to rant just I get wound up when I think of how long I have been trying to show them how bad my back is. This thing has been in the pot for about 2 years fo far and my knees for about 8 years. Have a good weekend...

One thing to say when discussing pain med side effects is that they make you unable to concentrate and that you often fall and lose balance. You can't sleep at night due to pain. You are short tempered and frequently snap at wife and feel awful afterwards. You feel depressed and anxious about the future. You are afraid to leave the house because you never know when pain will strike and reduce you to helpless state. This is the kinds of things that chronic and severe pain do to a person.

      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
