I am not real smart but if you now have TDIU which is paying you atthe 100% rate and they gave you CHAMPVA and Chapter 35 for the kids and spouse I sure would NOT be filing claims for 10% issues because you will never get from 80% to 100% that last 10 and 20% can be the hardest ratings to get because as you should know by now in the VA 90 + 10 does not equal 100 it equals 91% and gets rounded down to 90% unless it is something like hypertension that will open the door to cardiac issues down the road I would not file any more claims sometimes it is better to let sleepig dogs lay everytime you file a new claim they can reopen and look at all issues so unless it's worth it I would not have them re-opening your TDIU award for an issue that is not going to gain you anything there is not a lot of difference in being 100% schedular versus TDIU and many people think TDIU is actually a safer award that 100% schedular they can declare anytime that a 100% schedular vet has gotten better and propose to reduce on the other hand a TDIU vet basically the only way they can get into trouble is to get a job and have the income reported to the IRS who will turn around and tell the VA that they are working....... take some deep breaths and enjoy what you have earned and remember this will probably be the last large check you might ever see, and remember that there will always be rainy days so put some away and do not get yourself locked into payments that spend all of your check before you get it every month my wife and I live on a budget that does not allow any payments to exceed 50% of our total take home income so we are never pushed to the wall and we are capable of saving 10-25% of our income monthly which allows for some nice vacations annually I have learned to tell the kids NO lol

I get what u mean testvet, but i was saying im only 2 person according to my break down from being 94.5 which rounds to 95 which rounds me to 100% on my own. Its something i still have to address with my vso if its even worth it, thanks for the heads up.

I also have to address smc. My paperwork is in the mail for my id and the champ va stuff and some other "state" things the lady said, just don't know what all im entilted too. I cant wait to get this to my ssdi lawyer, i got my second denial letter the other day (which he suspected was gonna happen) so it should help with a judge I HOPE haha. Ive been pretty much denied ssdi because im 25

Congrats and I will second Pete's reply because I am TDIU P&T as well. Maybe it was a newbie at the 1800 that gave you that info. Great that you got it. I been debating with myself about opening up that can of worms I am 80% TDIU but I keep thinking they never included my bulging disk and all my neck injury in the make up as proven by the more recent MRI's and should it progress and spinal stenosis get worse I sure like to make sure its service connected. But I guess it really doesnt matter cause they would still do whatever surgery I guess just because I am TDIU I think. It just keeps bugging me. I probably need to just take another of my anxiety pills.blush.gif

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
