Need Some Help With Form 9

Question

Well my NOD came back after 18 months and my sleep apnea was denied again. I am going to write up the form 9 and get in line. I have an idea of what I want to say, but am not sure how to start it out. I want to cite a few BVA cases that mirror mine in the form 9. Any help with some examples would be awesome!! thanks in advance

Yes to all your questions except 1...my SMR are silent of OSA. I never complained about it. I did not know I had it. But I went to my TAP class in apr of 06 and a VA rep said that you have a year to submit any claim that is not in your SMR. I took that to heart and knew I had plenty of time ater I retired to get a sleep study. I had just had my gall bladder removed a month earlier and had some complications with that. Now check this case out. This is the kind of stuff that gives me hope. I was diagnosed with OSA 89 days after I retired.

In the BVA decision youir referred to-6the veteran had served from 1986 to 2006.

The wife's lay statement was for period of time she observed OSA symptoms during the veteran's active service period.

This is why they felt her opinion was probative.

Have you attempted to get buddy statements from anyone in your unit ,same time and place, who could verify your sleeping habits inservice?

Yes, Keep Posting! I take it you havent had any more "glitches" in software not allowing you to post because you posted too many times. (I think you need to post more!) If you do have another glitch and cant post try this:

1. Type up your post and hit "Ctrl A"...That means "select all"

2. Hit "Ctrl C". This copies the selected information to the clipboard, in this case all of it.

3. Point your pointer at a blank spot on your desktop. RIGHT click, then select "new". then go to your favorite text editor, such as wordpad, Microsoft Word, Open Document Text, etc. You can give it a name such as "Berta's July 10 post". Open this document and point your pointer at a blank place in the page and click. Then

hit "Ctrl and V" (paste) at the same time.

4. These desktop shortcuts make copying and pasting and saving easy.

5. When you save it, and the site is working again, say the next day, then go to your saved document, and copy and paste it into the hadit post.

It hasn't happened in a few days.My time is limited so I do have tendency to read as many new posts as I can right away and I reply fast because I dont know when I can get back to the site during the rest of the day.

I think the BVA's rationale on that BVA decision posted in this thread was that if the wife could verify the veteran's sleep patterns, then obviously since he was still active duty during that time ,then his buddies inservice could have verified them too.

Unfortnately the BVA really doesn't always tell us- in awarded decisions- all the evidence they considered.My case was a good example.I felt if BVA mentioned more of my evidence, maybe it could have helped another widow in similar situation.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
