Decision On Iu

Question

I received the decision on my claim on regarding IU. They stated that my service connected conditions combine to an evaluation of 90%. Therefore I meet the schedular requirement for IU. A statement I sent them from my doctor. He stated that I unable to maintain gainful employment. I had to quit work in 2006 due to my pain from 4 lower back operations all concerted failed surgeries. Also from side effects of pain medications. After quitting work I started working 2 or 3 days a month. My income for 2006 was 0, income for 2007 was $825.00, 2008 was $3150.00, 2009 was $2100.00. All well below the means for my area. I was denied IU due to I have not sent them my tax statements for those years. I sent them my tax statements for those years along with a letter of disagreement. Can anyone tell me what all this means? Did I do the right thing? The service officer helping me has not returned any of my calls since April of this year. Any help will be greatly appreciated! I hope this makes since to someone.

Sounds to me like "ya dun good!!" With that little income you should be awarded TDIU, without any problem, but don't spend the money yet, cuz ya never know what the VA might do. jmo

It sounds to me like you need to hand carry this information into the VA and get a date stamp that proves they have received it. You could also send it in certified signature receipt or express mail receipt to make sure you get a signature of VA receiving it. VA often claims that they did not receive evidence and fail to review the entire record. The only thing you can do is resubmit the evidence. If it is within one year of your rating, then file for a reconsideration. If it is close to the end of that one year then file a NOD.

My intentions are to help, my advice maybe wrong, be your own advocate and know what is in your C-File and the 38 CFR that governs your disabilities and conditions.

Do your own homework. No one knows the veteran’s symptoms like the veteran. Never Give Up.

I wonder if the idiots at the VA understand that with the incomes you stated you are not required to file tax statements. It has been fairly recent that I have seen them asking for copies of tax statements.

Its a good thing you have evidence and I would send them a letter (notice) that you want them to go ahead and make the decision with the evidence they have or they might drag this out.

On the positive side it looks to me like you proved your claim.

If you have Social Security Disability send a copy of award letter and if you don't apply for it.

Veterans deserve real choice for their health care.

Posts like this are happening more and more! What is wrong with the VA acknowledging the have received the documents. Our mail system is just NOT that bad!

The VA really needs to get the mail rooms up to snuff or contract it to China or something to improve it. Post like this are no way to treat a vet.

I hand carried my tax forms to the county for just that reason to make sure they got it! I also of late FAX everything and mail to the RO's when the request them.

If the VA is getting duplicates of every veteran that files a claim what a energy waste!!

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
