Question

First it was a furlough scare, now all of a sudden $$$ is being shoved at the VAs nationwide. We were informed that starting May 2 there will be MANDATORY OT of at LEAST 20 hrs a month. They are even having the trainees who qualify do overtime. Nehmer back cases are "supposed" to be done by end of this month, meaning we get those raters & developers who were working those cases back to work all the other cases. And I was told they are supposed to rework the 'points system' we are on, but I'll believe it when I see it. The points system is a stupid way of measuring production and has put many people on a PIP (Performance Incentive Program), meaning my boss has to spoonfeed me cases so that I get a mix of issues and can meet their crazy high #. Many ppl have been, are or will be on a PIP soon, thanks to this point system, which of course does wonders for our productivity/morale. Not to mention that we can't spend time doing the crazy large issue cases cuz, well, we have points to make! I wish Congress would do away with it already. Anyway, just letting y'all know what's going on.

@Carlie: I have my boss waiting for an answer from "on high" to see if those of us on PIPs qualify for mandatory OT. We aren't allowed to work voluntary OT (and it makes sensem, becuz if you are being PIP'd for production it means u are having trouble meeting your points, so why would you take on extra). However since this is a mandatory thing being issues nationwide, there might be an exception. I always volunteer for OT & they know that, so maybe that will count for something.

@Terry: Oh the backlog is def. nationwide, but we are always told that NY is pretty bad re our production & accuracy. Great morale boost. I'll let them know you gave me extra pts ;) Good luck to your daughter.

@Just: TY. I do welcome the $$$ (if I'm able to work it). At least more cases will be promulgated. And They are toally not caring about whether we are burned out or not...their reasoning is that we're lazy to begin with, so *crackwip*. (yes, we got that lovely speech said to us from our managers that there is a "cultural" laziness going on with us that we stop doing cases once we reach out points for the day. This is VERY interesting to those of us on PIPs who have been having trouble getting anywhere near the required pots...who exactly are these ppl that stop???)

Anyway, good luck with the IRS. And who's this FICA person & why does he get my money??

@Cool: urrrrg...i remember call centers, having worked at the INS one....never again! I feel your pain!

Update: from what I've been told, old Nehmer cases are supposed to be all done by end of this month. Those of us on PIPs will NOT be able to do overtime (guess they don't wanna set a precedent) so i can't do that till July sometime. But at least rest of office can. Now that we will have the Nehmer project people back to doing ratings, this will hopefully be another push to get cases done...providing they don;'t invent anything else.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

Is there any way to find out how close they are to getting the old Nehmer cases done? What about all the new Nehmer cases that are being filed?

I just got an IRIS message letter, only took 3 days for a reply this time. 6 months ago it took 3 months for a reply. However the same reply, but left a note to call the Phoenix office at our toll free # 602 627 2977 and speak to one of our representatives(that is a recording message only! Also a review of the file shows your claim is still in a pending status-VA is experiencing an increased amount of claims at this time, its difficult to determine when your claim will be completed.

I was told last week that Phoenix is doing mostly Nehmer cases, I wonder if this is true as of last week, or if Phoenix is tasked with doing only those claims to get caught up.?

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
