I feel like I'm in the twilight zone.

I just spent over an hour on the phone with my VARO,

this time - they called me.

They are trying to finish up the BVA remands and one of the issues

is dependent compensation that was correctly applied for (in 1981)

but was denied and has remained denied throughout all the times I have appealed

the denial.

The VARO guy went thru my file while we were on the phone and tabbed all the evidence

we discussed - he stated this is definitely a "CUE" on the VARO's side and he stated he is

taking it to a DRO right now to see how this can be rectified in the quickest way.

He said he is working there today until 5:00pm and will call me back before leaving for the day.

When (if) he calls back, I will post whatever I find out.

Sounds like there might still be a little cha-ching left on the table.

My daughter's mortgage is in foreclosure, so this would be great if (when)

it's finally approved and paid : -)

Just got off the phone with Mr. VARO again.

He took everything to the DRO - he states that the DRO agrees that the prior denial's

of dependent compensation is a CUE.

He states that all that is needed now is for a "Super Senior Supervisor"

to run the dates and numbers to come up with a figure.

The way I see it is that (at this point) dependent comp will be awarded from

06/06/1978 thru 12/31/1982.

In Jan 1983 my percentage was reduced from 40% to 20%.

There is still an issue on the table of EED of 10% for headaches - back to day following separation.

If this gets granted - then the dependent comp issue should be paid from 06/06/1978 thru 01/22/1993.

which is when my daughter reached 18 years old.

instead of from just between 06/06/1978 until reduction from 40% down to 20%,in Jan 1983.

The EED being granted for this 10% - would keep me within the eligibility criteria (30% or higher)

for many additional years of dependent compensation.

Well - I'm sure this is about as plain as mud - does anyone else understand it as clearly as I do ?

Down near St Pete - my AC doesn't even have an option to be turned off : -)
