Question

Just obtained copy of my C&P exam. It pertains to two specific conditions - R/L Knees, and Spine. INcluded under both is the question 'Does the veterans xx condition impact his ability to work' with the medical examiner's response as YES.

Is this an indication they will put me as unemployable? Or could they possibly put me at 100% employable with a condition that I'm restricted on what I can do?

Any input on this is most appreciated!!!

Just MHO. The doc at the C&P can say yes but that does not mean you will get UI. It's up to the raters and how they see your records along with the C&P results. With him saying this is a good sign in my opinion. Not the expert, just from what I have read and researched on this great site and a few more.

Are these conditions already service connected?

"R/L Knees, and Spine." Is this what the 20% you get now is for and was this a claim for higher rating than 20?

Otherwise what the examiner said as to unemployability would require the knee and spine conditions to be fully related to your military service.

How did the doctor respond to any questions regarding the cause of this disability, and your service?

If the knee and spine disabilitys are already service connected (or is the 20 % unrelated to them)

or the evidence shows potential for service connection-then if I were you I would apply for TDIU.

Standing alone, without the other C & P info,this statement:

"INcluded under both is the question 'Does the veterans xx condition impact his ability to work' with the medical examiner's response as YES."

might award a pension if you are wartime vet with limited income, but it has no relevance to the actual service connection nexus you need.

Can you scan and attach here (c0ver the personal stuff) the actual C & P results?

Bertha - i'll keep trying to scan the docs. I am actually now @70% (10 r/k, 20 back, 10 tinnitus, 50 ptsd). My c&p is for appeal to increase back, r/k, and claim for s/c l/k. C&p does also include (for lk) 'the condition was at least as likely as not incurred in or caused by claimed in service injury, etc'. Seems promissing that they will grant sc l/k.
