New to this kind of claim, but a vet with Hadit. I wanted to let the good folks here know that, I had my PSTD comp exam. never really thinking this would come into play in my claims, I was wrong. I went through some real crap oversea's and it is bigger then I would have thought. I really have thought about it since and I guess admitting it would be my first step... It was all in my files--- 3 stressors and from what I am seeing from the copy of the report the doc says a deffinate out come from my duty, and from the guidlines I am following from this sight alott higher then I would have ever admitted to. Maybe I will finally be free of this Maze i have been in sence 1991. Thanks all Again... you people are all price-less.

Rick, good to see you back at hadit.

That is the bad part about PTSD, it can affect vets in so many ways and often they dont attribute a lot of their feelings and problems to Mil service, and sometimes it can take years to bring it to a head.

A vet I know who worked for VA as a supervisor for years used to give the PTSD vets employed there a real hard time. He even woud call them crazy. He gave my husband a hard time on the job a lot.

A few years ago he called me out of the blue-VA had just put him on a stress leave and was giving him treatment for PTSD.

The guy felt so guilty for the way he had treated my husband and other PTSD vets on the job. He had been diagnosed with it due to his Vietnam service but told me he had never made the connection in almost 30 years.

It scared him too to have the diagnosis but he said for the first time in years he was starting to understand himself better and maybe with the diagnosis and treatment his wife would stay with him. (She had almost left him many times).

I dont know if there is a vet center near us Rick and I think Bath VAMC might still have a PTSD group meeting there.

In any event with this diagnosis, they are bound to compensate you for PTSD.

Sometimes ,for some vets I know, the diagnosis is a relief.

They learn they sure arent crazy at all and find that thousands of other military brothers and sisters are dealing with PTSD too.

Hadit is still te Best place in town for VA claims help!

Got Envelope Today...70% Now Maybe I can Get the I.U. that I have needed sence 2006, when my shoulders had the limit of what could be expected of them - 5 years later.I am seeing the end of the journey that I never wanted to be part of. It was 1992 when the first Doctor said ,Mr Macool your done. I survived for alott longer then they thought. Thanks To The D.A.V. for there help in filing, things are moving like they should have, from the start.

did the VA enclose a TDIU form?

It is always good to hear that a DAV rep helped you.Many reps bend over backwards for vets and ,as much as I gripe about reps, I know there are many good ones.

Hi Berta

No form is here. But My Reps from the DAV have me submitting a letter saying that I want to file for the I.U. to the Buffalo office, they will take it from there,file for me in My behalf. I am in great hopes that soon My old wages will be almost--replaced with a fair award of the Unemployability. Our lifes will be back to somewhat normal it has been, and still will be real hard to make it work on what I get from the VA..until that Time things are still going to be tough.. : ( ... but I can see the end of the road. where I can be safe and secure with My family again. You would think that when a Vet can't work any longer they would help, not so for me. I am in great hopes of being done with this" with the DAV's help. : )

      Frost v. Shulkin (2017)

This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
