So, I filed my claim with St. Pete RO Jan 24th, 2011. C&P's in March 2011 and stayed in Gathering Evidence until March 22,2012 when it moved to Preperation for decision. Today I checked and it says Pending Decision Approval. Ok, I admit they told me Prep. for decision was taking 70 days in my RO...this has been just over 30. My stomach is in knots. No new forms under my download forms....

I know it could go back, I expect I am going to be disappointed when the decision comes in, but the waiting...the waiting is KILLER. UGH. THANK YOU GOD for some movement though! I'd like to get the decision and know what kind of battle I have ahead.

According to my conditions, and the 38, I expect 50% to be a fair rating. However, I know fair isn't what the VA tries to give you. They want you to have the smallest rating possible, IF they even SC your conditions. Such a frustrating process. I am just staying in prayer, and TRYING to let it go. This is really gut wrenching.

Thank you NJ! :) I will for sure. I am just so thankful that there is movement, and hoping it will be a fair decision. There is a weight lifted a as a part of me worried they would deny it all. lol At least I know at least 30%.

Ok, today is 4 days later and nothing yet. I don't expect anything will update on the weekend. I will just have to keep my mind on other matters until Monday, and start the madness of checking the letter generater again. lol I just know if anyone at the VA checked my account activity they would feel embarrassed for me with the frequency I have checked that letter generator. LMBO. Well, I hope anyone else on this waiting game with me will have a great weekend and that we hear good news soon!!!wink.png

I agree about spending wisely!! Mine was spent having the entire outside of the house painted,(paint alone was over 900.00, the roof repaired and painted and car repair. If you are expecting a retro, you need to make list and have the most important done first. As a homeowner, the roof is the most important. It was cracking around the edges, and with the monsoon in a few months, that is top priority.

E-benefits is not always updated timely. You could have a claim in the gathering evidence stage, and the next day it will show closed. It is just used as an estimate on the status of the claim.

I would wait till the end of next week to check. Checking this everyday(even though you probably will) is going to make you go nuts with anxiety attacks. It will show something shortly, just find something else like another book to read to keep your mind off this issue.

I suggest you apply a dose of "the tincture of time."

At this point, I don't see eBenefits as having any real legal validity. While it perhaps might be somewhat helpful to some, is NOT a source of legally valid information. One might say that eBenefits is for informative and educational purposes only.

Try to give yourself one full week to leave the 800 #, ebenefits and/or iris completely alone.

Since VBA has your bank account number - just check that about once every 3 or 4 days.

You already know that good news is on the horizon.

Find something to do - let this run it's course a bit more WITHOUT running you.

Hang in there - don't let this control your life right now.

Someone posted making plans for how funds need to be spent - work on a priority list

of utmost importance first - like if your roof has problems, etc. . .

Carlie passed away in November 2015 she is missed.

You're right. It is totally running me at this point. I have vowed not to check today, and so far so good. (Ok, it's not a BIG step since it's Sunday, and probably nothing would show up today anyway, but it's a step.) ;) I am going to make out a top priority list tonight. My biggest goal is to have savings when this is all said and done.

I look forward to updating next week with some good news. :)

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
