IN 2012 THE COURT RESTORED MY PTSD 70% TO ME, IT WAS TAKEN AWAY FROM ME IN 2005, HAD A LAWER TAKE CAREOF THIS FOR ME, VA RESTORED MY S/C BACK TO ORININAL DATE OF 1997, [iS THERE ANY RETRO PAY INVOLVE IN THIS } LET ME KNOW, VA DID NOT ADDRESS THIS IIN MY CLAIM 2012, ALL THEY ADDRESS WAS MY SHOULDER AND A&A.

I HAVE BEEN TDIU SINCE 2002

IN 2012-RESTORED MY PTSD-70%

IN 2012- S/C FOR HEART-60%

IN 2012-INCREASE IN RIGHT SHOULDER-50%

PAID AT THE 100% SINCE 1997.

I WOULD APPREICIATE ANY HELP WITH THIS, ALSO PLEASE EXCUSE ANY MISTAKES I MADE, AS I AM LEAGALLY BLIND BY THE VA STARDARDS BUT MY BLINDNESS DID NOT HAPPEN IN SERVICE, SO NOT S/C.

Yes, it is an SMC award.

First conventional A&A is based upon pension rather than compensation. You are receiveing compensation, so the pension side is not appropriate.

Next there is a gross asset less than requirement $80,000?. Finally, if you happened to be a recent veteran, there may be a new program that you might meet the requirements for. Being an old Vietnam vet, I haven't bothered to get into the details, since the idea irritates me. (Home care benefits that are not available to us.)

If the VA has been paying TDIU at the 100% rate since 1997, I doubt that (with the details you mentioned), that any reto is due. But, it might be if the VA forgot to properly add such things as dependents, etc.

It may be that the VA decided that TDIU met the 100% SC creteria, and the 70% in addition entitled you to SMC. There are different levels of SMC, and it's possible that the VA awarded a level that is lower than you might be entitled to, depending on the gory details.

"MONTHLY ENTITLRMENY AMOUNT-3,368.00" This does not match the current SMC L rate, so I don't know how this was figured. ($3,446) seems to be current)

it appears that you are being paid SMC S at this point and time, I am married and get 3661 and am SMC L when I was getting SMC S it was about 3300 a month, to qualify for aid and attendance you basically are wheel chair bound and bedridden and need someone to do assistance with all aspects of daily life, getting you food, bathing, full time care, pretty much, I filed for A&A in Nov 2011 and it was approved in Nov 2012 after a thorough C&P exam that lasted about 2 hours I am in and out of ICU it seems on average about once a month due to congestive heart failure for the past 3 months I have had a home nurse that comes in weekly and assesses me and sends the VA a report the first 2 months it went to medicare and then it transferred to VA pay in the 3rd month

you do not appear to be rated at SMC L but at the S rate

100% SC P&T PTSD 100% CAD 10% Hypertension and A&A = SMC L, SSD
a disabled American veteran certified lol

You got TDIU in 2002 and then an extra 60% in 2012. According to Bradley vs Peake you are entitled to "S". I got TDIU in 2002 and got an extra 60% in 2008. I got "S" quoting Bradley v Peake. They called a CUE on themselves and I got two years backpay because I did not ask for "S" until 2010 because I did not know I was qualified.

CHECK OUT THE TABLE FOR THE S AWARD,IT STATES THE AMOUNT OF $ 3,368,

IS THAT A SEPERATE AMOUNT NOT TO INCLUDE MY TOTAL DISABILITIES PAYMENT OF $ 3,088?

CHECK MY ACCOUNT AND THERE PAYMENT WAS $ 336.00

MY S AWARD WAS FOR SPOUSE AND ONE CHILD

ARE THEY ADDING MY DISABILITY PAYMENT ($ 3,088) AND MY S AWARD ($ 336.00)?

WHEN I ADD THIS TWO FIGURES IT GIVES ME $ 3,424 .

FOR EXAMPLE, DO I ADD THE S AWARD ($ 3,368) AND MY DISABILITY PAYMENT ($ 3,088) TOGETHER?

IT WILL GIVE ME $ 6,456 . I AM SO CONFUEED, I AM A SIMPLE MAN,

HOPE I GAVE ENOUGH INFORMATION.

      Service Connection

      Frost v. Shulkin (2017)
      This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected. 

      Saunders v. Wilkie (2018)
      The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
      This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
