Term Limits For All Va Officials

Question

What would it take to have a bill brought to congress that requires that every 4 years, the secretary of the va, the undersecretary and several others further down the chain of command, would be MANDATORY elected by the people of the united states. When we vote for a new president, the VA SECRETARY, THE UNDERSECRETARY, AND A FEW MORE im the chain, can either be re elected for one more 4 year term, or they go home and ask forgiveness for thier sins. This would give the people who hold these positions a reason to do thier jobs, and it would hold them accountable. Also it may be possible for the president to do it as an executive order/

Unless the VA becomes accountable for thier actions, things will surely just get worse. As we have seen over the last several years, congressional oversight commitees cannot seem to make the va do anything. They cannot shame them, they cannot persuade them, they cannot encourage them, they cannot order them. The va was founded by our forefathers on a principle, and that principle was

CARE FOR THOSE WHOM SHALL HAVE BORNE THE BATTLE. In these present times we live in, there is no respect, mercy, or kindness shown to veterans, its all a numbers game, with greed and corruption running rampant. We must change, along with the times.

If the VA employees 100.000 dollar a year jobs were on the line, they would get thier acts together.

The Leader selects the cabinet positions. The VA Secretary is a cabinet position. He usually selects someone who resembles a puppet. In reality he has no power. Just a figure head. Its like a Baseball Manager. He manages the team on the field., The GM and Owner usualy make the decisions.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

So Obama appointed Shenseki, who then apointed apointed Hickey, ?

Surley a system of distancing themselves from responsibility.

Why cant we petition congress to put a bill into motion that requires the va secretary to be elected , and not appointed.

Isnt this how this country is supposed to work, we the people change things that arent working? That system was likely put into place when government was still small, and the presidency and Va secretary position was a position of honor, integrity, statesmanship and compassion for the people. Not like what it is today.

here is the reasoning that was used, when they changed the laws.. They said that the Secretary of the va, needed to have direct access to the president.

If the secretary of VA were an elected official, it would not affect that acess. If a new president, or new Va secretary get elected, they will have to work with each other, and take care of veterans. If one chooses to not support the other, then it will affect thier election outcome.

The Department of Veterans Affairs Act of 1988 (Pub.L. 100-527) changed the former Veterans Administration, an independent government agency established in 1930, primarily to see to the needs of World War I veterans, into a Cabinet-level Department of Veterans Affairs. It was signed into law by President Ronald Reagan on October 25, 1988, but actually came into effect under the term of his successor, George H. W. Bush, on March 15, 1989.

The Department of Veterans Affairs was created due to nearly one third of the population being eligible for veterans benefits. Its proponents argued that due to the large number of Americans affected by the VA, it needed an administrator who had direct access to the president.[6]

Can anyone think of a reason why it would not work? surely the president would like to have the VA monkey off of his back, and not have to take that heat from vets when the Va gets sideways with vets. If the ELECTED va secretary is screwing up, he will be replaced at his 4 year mark, or sooner if malfeasance is proven. Congress can still act in an oversight capacity, and work with the elected Secretary.

The VA was never meant to be the MAFIA style organization that it has become, that answers to nobody, and does as it pleases.

The law was not made so that the VA had Access to the President, it was made to gain Protection from the president, and secrecy.

The VA is a Business of immense proportion, Why did they appoint a old retired Army general, who probably cant balance his own checkbook without his ole ladys assistance. Did they do it so he could stand there in his dress greens, with his chest full of ribbons, as a figurehead, that vets could relate to. Did they appoint him so we would think, hmmm we are in good hands, look at that old General they got, up there fighting for us, like a good man should.

This country needs to ELECT someone with QUALIFICATIONS that are needed to run a monster as big as the VA. They need someone with skills, in business management. Things are not going to change, until things change.

THE SECRETARY OF THE VETERANS AFFAIRS MUST BE AN ACCOUNTABLE OFFICE.

If the secretary were an elected official and his job were at stake, he might start getting rid of some people starting with the cock eyed . hairspray bingo queen who is goofing everything up right now.

Congress votes the money for vets. Have term limits for senators and representatives. Some have to be carried into the congress on hospital beds like Bird and that old Dixiecrat Strom Thurmond (sic).

Also they say the reasoning is that 1/3 of the population of the country was eligible for va benefits. Keep in ming this time period was well after vietnam and before desert storm. So I dont think 1/3 of the country were veterans and dependant of veterans at that time.

They used that as an excuse to form the current system.

    • These decisions have made a big impact on how VA disability claims are handled, giving veterans more chances to get benefits and clearing up important issues.

      Service Connection

      Frost v. Shulkin (2017)
This case established that for secondary service connection claims, the primary service-connected disability does not need to be service-connected or diagnosed at the time the secondary condition is incurred 1. This allows veterans to potentially receive secondary service connection for conditions that developed before their primary condition was officially service-connected.

      Saunders v. Wilkie (2018)
The Federal Circuit ruled that pain alone, without an accompanying diagnosed condition, can constitute a disability for VA compensation purposes if it results in functional impairment 1. This overturned previous precedent that required an underlying pathology for pain to be considered a disability.

      Effective Dates

      Martinez v. McDonough (2023)
This case dealt with the denial of an earlier effective date for a total disability rating based on individual unemployability (TDIU) 2. It addressed issues around the validity of appeal withdrawals and the consideration of cognitive impairment in such decisions.

    • I met with a VSO today at my VA Hospital who was very knowledgeable and very helpful.  We decided I should submit a few new claims which we did.  He told me that he didn't need copies of my military records that showed my sick call notations related to any of the claims.  He said that the VA now has entire military medical record on file and would find the record(s) in their own file.  It seemed odd to me as my service dates back to  1981 and spans 34 years through my retirement in 2015.  It sure seemed to make more sense for me to give him copies of my military medical record pages that document the injuries as I'd already had them with me.  He didn't want my copies.  Anyone have any information on this.  Much thanks in advance.

    • Caluza Triangle defines what is necessary for service connection
Caluza Triangle – Caluza vs Brown defined what is necessary for service connection. See COVA– CALUZA V. BROWN–TOTAL RECALL

This has to be MEDICALLY Documented in your records:

Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • Do the sct codes help or hurt my disability rating
    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
