what does the DOD / or military personal in charge of veterans service records..what and where do they send them?

Most prior Vietnam Veterans that were there before the fall of Saigon of 75,   in the late 60's to early 70's  for some of us the unit we were in has disapated and no longer exist According to ( Google Search) I put in my unit name Battillon AP0# and they can't seem to find any records...OK I called NPRC (Archives) St Louis they said ARB has all my Records. NRPC Lady says they have them because I have a claim in  . I said butI don't have a claim in I already have my claim decided back in 2015  Then she kinda got hissy fit with me we don't have your records and said she is disconnecting this call now  conversation over. eh!

My old unit in Germany no longer exist either according to google search. but I was there for 10 months just south of Mannheim Germany & just outside Heidelberg  Germany in Tompkins Barracks but I was there  eh!

Here is a link of the closing of Tompkins Barracks/where I was station about 46 /47 years ago.

http://www.rafino.org/ShowContent?id=788

ARB (Army Review Board of military records correction) Contacted me and said they don't have any of my Service Records to make a correction on my 214..AND DENIED MY CORRECTION..I have one Year to submit more records of evidence  with the dates that are correct.

So how else can a Veteran that needs his  complete military service records get them?

My reason for asking is I am trying to get my DD-214 Corrected  b/c of the service dates are incorrect and they don't show my Germany service on it..only Vietnam Service  but the dates are wrong on that too.

I have been fighting with the ARB (Army Review Board of corrections military Records) in Arlington Va

I sent them old unit records/ TDY Travel Orders and any records I had to support my correction.

I seem to have lost my Orders after Basic Training and AIT  but I wrote ARB a letter  in detail the dates I was in basic and where and the dates from AIT and where &as close to the dates and where for Germany & Vietnam...Well that's not good enough either  ARB says they need Military unit Records...I don't have any and can't seem to get any.??

I even sent what records I had  that I used in my PTSD Claim  Mostly Vietnam Records...they are not good enough either b/c the dates where actually when I was in Vietnam  and not my ETS from Nam  that's the dates I need because I extended my tour longer than the required 12 months of Vietnam Duty.

Any help from anyone would be appreciated.

Buck, When you file for any kind of veterans benefits the RO request your records (SMRs) from NPRC, St. Louis in your case. NPRC sends the RO your original records, not a copy. The RO places those original SMRs, in your 201 file, along with anything else that they might have in your claims folder and it never ever leaves that folder again. Your C-file remains at the RO. At the point of two years of inactivity the folder is moved to an off site facility where it can be accessed at any later date. If you move to another region, notify the RO and they will relocate your C-file to your new local RO.

With proper notice, you can make an appointment at the RO to view and go through your C- file. Someone at the RO will be assigned to sit with you and watch you to make sure that you do not add or remove anything from the file.

If you call the NPRC requesting a copy of the SMRs they will need to contact your RO and have the RO send a copy to you. They seem reluctant to comply but if you request a copy through a congressman or senator's office you will get a nice complete copy of your C-file in a reasonable amount of time. Your congressman or senator has a standard release form that you will need to sign upon the request.

I was in Heidelberg in 1969 & 1970. I was at Tompkins Barracks many times during my stay in Germany. I was in the 519th Trans Co. The 519th no longer exist either.

Thanks James

This is not for claim purposes , its to make a correction with places and dates on my DD-214.

ARB (Army Review Board) Arlington Va & NRPC, St Louis Thinks its for claim purposes and NRPC says ARB has been sent all my Records.

B/C I did File a PTSD Claim last year but that claim was decided back in 10 -2 -2015, so the Records have had time to get back to there proper place...I would think anyway?

I have most of my SMR/s  It's my military in- service records I need to prove where I was and the dates.

I have my C-file just got it back in July in CD-Rom  but no-in service records in it? only claim records and medical  & DRO Hearings & RO Stuff.

ARB  will not make a correction without any type military in-service records.

I requested my 201, and any or ALL in-service records from my complete military service 69 to 72 from NRPC and they say ARB has them ARB is saying they can't find my records while in Germany?

but they have a few from Vietnam, both units I was in do not exist anymore, I wrote ARB a nice long letter requesting them to find those records and make the necessary correction on my DD-214 Please.

NRPC  St Louis Sent me a few in-service records but not any from Germany.

It's as though ARB thinks I am lying through my teeth and I am not lying,  I just can't prove to them when I was there with in-service records,I promise to God all mighty I was in Germany @ Tompkins Barracks , Schwetzingen Germany, I worked at the EM,Club across the street just outside the compound as a BAR-Back Part time on weekends.

I was not married nor had a G/F at this time I never got letters from anyone  only from my mom but  they were few and in-between  I guess I lost those too?while in Germany I had a little cute german g/f from the local town but hell I forgot her name.  I remember all the German girls were extra nice and pretty. I ended up with a Texan  LOL

I gave a full detail of my unit in Germany to ARB and the dates as close as I could remember .

I use to have the travel orders & Itinerary  when I left German for USA but I guess they got lost? I don't know what happen to them.

I am contacting my congressman Pete Sessions from Texas and let him or his office know whats been going on and request his assistance in this matter.

I will listen in on the show and try to catch you guys live, some times I miss the live show  but yes they are recorded and put into the hadit archives, we all can go back and listen to the shows over & over  Thanks to Ms T

btw

Even though this is not for a claim but ARB is making this a personal thing with me  I won't give up until I prove to them I am not lying..actually it kinda pisses me off.

Those Records From Germany have got to be found  matter fact I was seen by the Dr's more in Germany than in Vietnam. so there should be Medical records of my service while in Germany  I have look and look tell I'm blue in the face in my C-FILE for any in service records .

I just want my DD 214 To be corrected and to be right.

It pays to repeat this info.

A DD 149 form ( available here at hadit under a search) is what is used for DD 214 corrections.

Just put "not applicable" to the 'injustice' part and mail with proof of mailing to where they direct you too on the back of or second page of the form.

It took us about  4 months to get a response from sending in this form , shortly before my husband died.

They sent a DD 215 that included awards/decorations he didn't know he had received...

There was scuttlebutt when his unit got back from Vietnam that they had received the PUC.1966.

But USMC made them fill out a form for their 214s, when many were being discharged, and they all wanted to get the hell out of there and really didnt know what awards they got.... 1968 Quantico.

Sure enough, it was on his DD 215 and they sent him all medals /ribbons except those that were made and awarded by the Vietnamese Government ( all purchasable on line or at PXs.)

Also there could be a Destination/Arrival document in your Personnel records. The one in my husband's records however is very limited.I dont even remember if it said Okinawa as well as Vietnam.

The DD 149 however is only for limited correction of a DD 214 ....they would not have access to some of the info you seek.

Thank you Ms berta

I'll sure try this, I have all my medals and awards most that I know of anyway & like you mention they maybe more? I don't know about.

I just want something to prove my military service and the time and places I served,  just personal reasons I guess & for grand children & great grand children to see.

The Vietnamese citizens gave me a wall plaq for my humane kindness toward there people , when we received our MPC payments through out the months/ years, I would give some to mama-son to take home to her family help buy clothes & food  she gave me that special made plaq the day I left Nam with tears in her eyes   that meant the world to me.  but its not military related stuff.

I have it hanging in my office here at home.

I want this DD 214/ 215 corrected before I pass.

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
    • Welcome to hadit!

There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

      https://www.va.gov/resources/getting-emergency-care-at-non-va-facilities/

However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.

When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.

However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.

That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.

Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.

Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

      https://www.law.cornell.edu/cfr/text/38/3.344

    • Good question.

Maybe I can clear it up.

The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      More here:

      Source:

      https://www.va.gov/disability/dependency-indemnity-compensation/

NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
