VA Central called me.........

 We discussed the three main parts of my letters to the President and Sec Shulman and  he said the new proposed bill regarding the appeals process contains some of my ideas I sent to POTUS and to the Secretary in February.

I have many more ideas...but this time of year I deal with so much as it is and I hope others are contacting the Hot Line with any ideas they have as to the claims process or the backlog reduction.

I have not even had a minute to read the new proposed appeals legislation....... anyone have a link????

The malpractice part........I might hear from OGC. the man from VACO was not sure how that will be handled ....and I have more evidence to prepare for that....

The complaint I made against the Director of the Buffalo VA on the hot line call.......---- I told him I will follow up on via snail mail........I am sure the Buffalo VA director is well aware of the complaint. And I have plenty of evidence.  

This is our chance to utilize the Accountability Act to i's full advantage. The VA does not know who the VA screw ups are. We all have evidence of C & P s that were incompetent. Many of us have had to pay a Real doctor to overcome them. The BVA reveals evidence of that fact.

Also the BVA reveals the lack of proper extention of our VCAA rights and  the countless remands, causing the backlog ,  mean re dos of what the VA was already paid to do right the first time.

But VA isn't going to listen just to some senior citizen civilian widow like me, living high up on the beautiful Allegheny Mountain plateau, hoping someday I can really retire from VAOLA , enjoying my farm and  surroundings, eating brownies and watching war movies and be truly done with  waiting for the VA to become equitable to every veterans and their dependents and survivors.

It will be up to veterans to change the VA....

or they wont. And VA will be Very happy to try to continue to maintain their Status Quo .

I agree with Hamslice

We all help one another , but in the end  its our  We the Veterans responsibility to work our own claims  , We can get help from here or VSO or VA  Reps and Attorney's  but like I said its the Veterans responsibility to work his/her own Claim or see to it that it is worked properly.

VA give us enough Headaches  why add to it.

I agree this should have put in social  news or where ever it can get but not in claims question.

I really don't care because the WH agreed with something she or you says should be the law.

How will this help vets that's all matter Veterans.

It will never be but if you complain enough you will get a BS response from the WH.

If you are good people will response to you but every info you or me says is not the law

for VA benefits. It ant getting any easer . Everyone who answer questions also helps

and just a little common knowledge can help in a lot of ways. Don't bet all your money 

on one horse race and expect to win it all.

This Bill,when it is signed into law  law ,can impact on Thousands of veterans, their dependents and widows, not to mention the men and women serving our  country now.

I guess I was supposed to post the Nehmer AO decision and info from NVLSP on  IHD,Hairy Cell B Parkinson's info in Social----

But You do not tell me where and what to post. 

And I bet you do not even have a clue on what the VCAA is anyhow.

Have you ever heard of the Pelegrino Case?    Nope I didnt think so. That is why you didn't get the EED you wanted. Broncovet told you it was a CUE but you did not heed his advise.

With all Due Respect ,

Ms berta 

she is a big Hero in my eyes and my heart..for giving her valuable time to us veterans and helping thousands of veterans through out the years and she does it without recognition,unselfish she helps all she can and her help/and valuable information is all free...she research things before she speaks  and her help is a God Send to many many veterans and their Spouses.

So in my opinion I know Ms berta is a Hero and a Veterans best friend   if I was not a Veteran I still would consider Ms berta my friend and like family. more so than some of my close family. 

she makes things a lot better/eazier for us Veterans   and stays on top of the VA Wicked System  and focus on making the VA Better a lot better for all of us Vets.

I consider Ms berta my Aunt Mary  and a wonderful hard working woman and wonderful Mom & spouse of some great Veterans.

You choose to pick a war with Ms Berta  you better bring all you got buddy  she will tear you up.

I AM NOT PICKING A WAR I JUST BE READING HER POST I know this is your 

buddy but the facts and do you need me to post the link on sueing a person because they disagree

with your assumption or just bad advice .

      This has to be MEDICALLY Documented in your records:

      Current Diagnosis.   (No diagnosis, no Service Connection.)

      In-Service Event or Aggravation.
      Nexus (link- cause and effect- connection) or Doctor’s Statement close to: “The Veteran’s (current diagnosis) is at least as likely due to x Event in military service”

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.  

      They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.  

      This is not true, 

      Proof:  

          About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends. 

          Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken. 

          A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did. 

          I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.

          There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

         However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.  

         When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.  

          However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.  

      That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.  

      Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.  

          Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

          Maybe I can clear it up.  

          The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
