If you have another part of the remand which was not favorable it would go back to the Judge for them to review. The RO should give you a rating you then will need to decide if you think that is the correct decision. So yes, the RO could overlook a examiner findings. But as Shrek said, you have the appeals process. It can be frustrating but realize that unfortunately there really are very few repercussions to VA individuals making claims decisions. Probably too often than they would admit, the VA will seemingly deny and hope the veteran will just give up in frustration and not follow through with appeals. That way the VA "Saves" money. Be positive; if you have a disability and have your evidence, you can win if you don't quit. Trust that the process will work. If, it doesn't, make it work. The results of the exams was deliver on Sept 25 to the VARO. How many days can the VARO gets to hold on to my claim without to make a decision to send it back to BVA?
