0 HadIt.com Elder GBArmy Posted March 4, 2021 HadIt.com Elder Share Posted March 4, 2021 A1329 Great find! Good reference site for the DBQ's. Notice the expiration dates on the bottom of the forms.
0 Moderator brokensoldier244th Posted March 4, 2021 Moderator Share Posted March 4, 2021 NIce. I understood why they did it but I wasnt a fan that they did. In any case, very cool. The thing about the dates on forms holds for EVERYTHING. There are a lot of VSOs that just grab a copy out of the drawer and send it to people to fill out, and if the form is not the most recent, or within a year past of the new form date, it won't be accepted. Not my monkeys, thats just the rule as it is now. Language changes on forms, new legal requirements mean the wording has to change, etc. Always double check that your VSO or website you got a form from gas you the most recent version. All forms are on the VA's website https://www.va.gov/find-forms/

0 Moderator brokensoldier244th Posted March 4, 2021 Moderator Share Posted March 4, 2021 (edited) How so? I’m not in front of my full screen (kids to school) but I know that III.iv.3.D.2.c mentions it. I’m not looking at the changes section, though. You can see all the changes at the bottom. https://www.knowva.ebenefits.va.gov/system/templates/selfservice/va_ssnew/help/customer/locale/en-US/portal/554400000001018/content/554400000015812/M21-1-Part-III-Subpart-iv-Chapter-3-Section-D-Examination-Reports#2b Edited March 4, 2021 by brokensoldier244th

Do they not have to accept all evidence? Even if it was filled out on a piece of scrap paper and signed by the doctor?
0 Moderator brokensoldier244th Posted March 4, 2021 Moderator Share Posted March 4, 2021 No. We generally accept evidence at face value, but you can't get SC based on the back of a cocktail napkin, in part because most of the exams require answers to questions that are required by laws passed by Congress and/or required by prior BVA decisions. Plus, accept doesn't mean that its evaluated as corroborative evidence. We'll take whatever someone sends us, but that doesn't mean it is factual or relevant to the claim, or has a medically sound conclusion. Accept, yes. Required to evaluate everything as gospel? No. Also, forms have dates on them for the same reason- because the text changes because it's required to. If the VSO can't stay up to date on that stuff-that is email blasted out to POAs and published on the VA website, what else aren't they doing for you?
