If a Veteran is direct Service connected why should his claim not go back to the date of service.

Very interesting; could have tremendous impact if they agree to an early effective date under these circumstances.

I don't think the will let this happen.

It would break the VA. 

I wish they would tho because the VA might better decision.

It might less appeals because they will give the veteran eef date of service.

For some reason I do agree with Mr. Cue. I do not believe it will cause more financial issues for the government. Furthermore, it would put more workload on the already missed VA claims deadlines. If this was to pass, vets would have to file a claim for it. Not automatic. 

Not trying to be negative at all but if it does, it probably would take years, maybe decades to implement. 

It would be nice if it would happen.

In reality it covers equitable tolling based on the Veteran filing a claim within the 1 year deadline.  If it is a win, veterans will have to show a strong reason for not filing the claim within the first post service year.

As of 10:24 am Eastern time, they are currently working on Merrill v. Milligan, a redistricting case. Once that finished, they are supposed to hear Arellano v. McDonough.
