Shoulder claim question.

Question

Im filing a claim for bilateral shoulder pain. I tore my left shoulder labrum doing PT in the gym in Kuwait, but never got seen because it was the week right before the invasion in 2003.  Never had it fixed before I got out cause I had to extend for ACL/Meniscus repair in 2005.

2014 I had a primary care visit for left shoulder pain and a lidocaine injection. A few months later an MRI that diagnosed a complex left shoulder torn labrum, old fracture and osteoarthritis.

The pain is now over on my right shoulder and I think there may be some issues on that side. I also keep having left side trap muscle pain with tingling in the upper back and arms/hands.

So with the bilateral stuff I’m throwing in the trap muscle issue, which I was seen by a dr for but never x-rayed.

**My question is, I have an MRI/Diagnosis for my left….but nothing for the right. Do I need to try and get an MRI for my right through the VA or community care? Or am I good? I feel like when this gets to the rater or VA they will deny because I don’t have one.****

Just FYI- Never filed  claim because I was under the impression it needed to be documented while in. I did get a buddy letter from guy in my squad I was lifting with and counciling statements from my Sgt saying use the gym for PT on our own

Hi Marc D,

I would put in your claim with their lay statement and with your own lay statement.  You will probably need to appeal it and keep pushing it, but it is worth a try.  See what they come back with after you put in for it.

Need an MRI of the neck also.  May have damaged the cervical discs or vertebra in that first injury.  I had cervical spine SC in 2020, 51 years after the injury that caused an undiagnosed disc herniation.  I had a slight loss of sensation on the left forearm that caused me to not be able to feel mosquito bites on that part of my arm until 2003.  That change was enough to get the 20% for cervical disc disease.  Going to ask for more because stenosis in the neural foramen is causing motion limitations causing difficulty getting dressed.  Will ask CCK to submit the claim so it can be decided by the BVA during appeal.

Put in the claim.  The examinations should be done from that.  If they are incomplete complain at the BVA and they should send them back to be done right.  If the BVA judge does not, appeal to the CAVC.  A pro-bono attorney should be able to get it back to the BVA for the right orders for examination.

Thanks. Yeah guess we will have to see. I put in the claim in January and I have my C&P Friday. I was reading a lot of Veterans Benifets post on Reddit and I see a lot of denials. I have an MRI for my left….was thinking they may say not to my right cause I have nothing.

Try to get a MRI of the Right Shoulder and stick to the buddy statements to direct service connect it. Steer away from the neck unless you have a documented neck injury. A secondary to the neck would require a neck to be service connected primary.  Another avenue for the Right shoulder would be over compensation since trhe left one was injured and you may have over used the right one. You may need an IMO to assist.

A Veteran is a person who served this country. Treat them with respect.

A Disabled Veteran is a person who served this country and bears the scars of that service regardless of when or where they served.

Treat them with the upmost respect. I do. Rejection is not a sign of failure. Failure is not an option, Medical opinions and evidence wins claims. Trust in others is a virtue but you take the T out of Trust and you are left with Rust so be wise about who you are dealing with.

They might say no, but that is why you find out and appeal it.  I have won all 4 of mine.  Keep fighting and you will get there.

    • VA has gotten away with (mis) interpreting their  ambigious, , vague regulations, then enforcing them willy nilly never in Veterans favor.

They justify all this to congress by calling themselves a "pro claimant Veteran friendly organization" who grants the benefit of the doubt to Veterans.

      This is not true,

      Proof:

About 80-90 percent of Veterans are initially denied by VA, pushing us into a massive backlog of appeals, or worse, sending impoverished Veterans "to the homeless streets" because  when they cant work, they can not keep their home.  I was one of those Veterans who they denied for a bogus reason:  "Its been too long since military service".  This is bogus because its not one of the criteria for service connection, but simply made up by VA.  And, I was a homeless Vet, albeit a short time,  mostly due to the kindness of strangers and friends.

Hadit would not be necessary if, indeed, VA gave Veterans the benefit of the doubt, and processed our claims efficiently and paid us promptly.  The VA is broken.

A huge percentage (nearly 100 percent) of Veterans who do get 100 percent, do so only after lengthy appeals.  I have answered questions for thousands of Veterans, and can only name ONE person who got their benefits correct on the first Regional Office decision.  All of the rest of us pretty much had lengthy frustrating appeals, mostly having to appeal multiple multiple times like I did.

I wish I know how VA gets away with lying to congress about how "VA is a claimant friendly system, where the Veteran is given the benefit of the doubt".   Then how come so many Veterans are homeless, and how come 22 Veterans take their life each day?  Va likes to blame the Veterans, not their system.
    • Welcome to hadit!

There are certain rules about community care reimbursement, and I have no idea if you met them or not.  Try reading this:

      https://www.va.gov/resources/getting-emergency-care-at-non-va-facilities/

However, (and I have no idea of knowing whether or not you would likely succeed) Im unsure of why you seem to be so adamant against getting an increase in disability compensation.

When I buy stuff, say at Kroger, or pay bills, I have never had anyone say, "Wait!  Is this money from disability compensation, or did you earn it working at a regular job?"  Not once.  Thus, if you did get an increase, likely you would have no trouble paying this with the increase compensation.

However, there are many false rumors out there that suggest if you apply for an increase, the VA will reduce your benefits instead.

That rumor is false but I do hear people tell Veterans that a lot.  There are strict rules VA has to reduce you and, NOT ONE of those rules have anything to do with applying for an increase.

Yes, the VA can reduce your benefits, but generally only when your condition has "actually improved" under ordinary conditions of life.

Unless you contacted the VA within 72 hours of your medical treatment, you may not be eligible for reimbursement, or at least that is how I read the link, I posted above. Here are SOME of the rules the VA must comply with in order to reduce your compensation benefits:

    • Good question.

Maybe I can clear it up.

The spouse is eligible for DIC if you die of a SC condition OR any condition if you are P and T for 10 years or more.  (my paraphrase).

      More here:

      Source:

      https://www.va.gov/disability/dependency-indemnity-compensation/

NOTE:   TO PROVE CAUSE OF DEATH WILL LIKELY REQUIRE AN AUTOPSY.  This means if you die of a SC condtion, your spouse would need to do an autopsy to prove cause of death to be from a SC condtiond.    If you were P and T for 10 full years, then the cause of death may not matter so much.
