Discision Board
The VA Rep from Milwaukee called the two weeks ago and said my brother's appeal was awarded 100% with P&T. We have other medical claims to file but he wants to wait for the letter and the big envelope. When we call they tell us its in the discision board,. Can anyone tell me what the discision board is and about how long wil we have to wait. I know its about 15-16 months reto pay could that be the reason that it is taking so long? JohnM's Wife Dianne

Copy Of C File
I have a claim in for increase but would like a copy of my c file. Should I wait uuntill after the decision or go ahead and put in a FOI for the copy. Will this stop/slow down my claim? Thanks for replys, Stillhere

Odd Thing Happened
I went there to see my file at NYSDVA. They had sent me a copy of it years ago. Not only are my claims missing (again) but the NOD I sent in on June 21,2007 wasn't there. I have the Priority tracking slip and they said they never got it. Of course I sent copy to VA and they did get it. What bothered me is this- there are client notes about me and the broohaha when I complained to them about the way my claims were handled.(dated 2005 and 2006) The rep did tell the truth about most of how it went (Jan 2003) and admitted he gave me back my copy and never made a copy of it-but he never triggered the claim with the VARO or NYSDVA.(the AO claim) but he never tol…

ptsd Nod Notification, Dro Hearing
Funny, just received word the other day that even though I have sent in numerous (4) copies of my NOD to the DRO for PTSD claim They still say they haven't received it. My lawyer who is my POA has also sent them copies of it and yet they still say that they haven't received it. The call came for my DRO hearing and I asked about everything that I have filed for that they have so I could cross check and make sure. The whole reason that I am going is for the lousy low ball award that they gave me for PTSD the first time. So now the DRO says that I can just bring all that up at the hearing because they say that the NOD will expire in DEC so there is plenty of time from the ye…

Need Help....
I put in an appeal that was post marked before the year period after calling the 800 and being told that as long as the post mark was earlier than the the denial letter(within a year) it would be accepted. I later told my advisor what I was told he said it must be in the VA hands before the year is up and that unlike the Internal Revuenue and other agencies the post m,ark is not relevant as it is the VA recipt stamp etc.. Mine was stamped at 900 am the next morning of the year. I then called the 800 number and was told the same identical thing that the post mark must be there and that it would go through. What Is The Va Definition Of " Ability To Function Independently" ? ..
I am starting to work on my NOD and need some help trying to figure out just what the VA means by the words they use. Pete, John, Josephine, 1968VV, Betrayed, Vike17, Berta, elders, advocates, or anyone that has experience with the mental disorders rating and VA rigamarole, please chime in. Rural Vets
I was contacted by Roseburg dental and told that I was elgible for Fee Basis Dental since I lived over 100 miles away. Called local dentesats and they said tyhey did take fee basis. called back Roseburg VA and then they told me I lived in wrong county not elgiblel. Anyone know anything about this or vets having to drive over 100miles for treatment. LLoyd

Dear HadIt.Com; Can my daughter file for retro-active Chapter 35 Educational benefits now ...even though she graduated a few years ago? My claim wasn't approved until 2001, however, the date-of-claim eligibility went back to 1998. She is now burdened with repayment of student loans; approval of this benefit will provide some relief for her. Has anyone out there ever had this experience? Question On "duty To Assist Letter" (vcaa) Form
On my decision letter dated 4-27-2007, I got a increase on my S/C lower back went from 20% to $40%, that's fine with me. But on my left and right lower extremity's, they were Deferred for " Duty to Assist Letter" the good old VCAA notice. So I sent in two VCAA letters one for each deferred item and a Statement in support of claim form. I checked the block to go ahead and make your decision as soon as possable using the info from my C&P exam on my legs. Now after reading,Dingess-Hartmen and Kent, VCAA Public-Law 106-475, this is going to be a denail on these two items??? Am I reading this right??? Medical Opinion Trumps Rater's Opinion - Where Is This?
I need some help here. I'm trying to work on my NOD and it is slow going. I have been out of the loop for a couple of months (have not been doing well) so this may be or have been on hadit before and I just missed it in my search but I thought I read somewhere that the VA reg states that a rater cannot use his/her own opinion over a medical opinion. I would like to cite that in my NOD but I don't know the reference. Would someone please tell me if I'm either crazy (never mind, that's the one thing the VA and I do agree on so I don't need confirmation of that) or give me the citation of where it is stated that a medical opinion trumps a rater's opinion. I have a few questions but thought I provide background to assist in answering. I submitted my service connected claim on March 16, 2007 for Psoriatic Arthritis (PSA) and Psoriasis. I was active duty in the Navy for ten years (1980-1990), I started having skin problems in 1982 and it intensified during my last three years in the Navy.
