Deshotel
The U.S. Court of Appeals for Veterans Claims (CAVC) recently issued two decisions (Richardson v. Nicholson, 20 Vet. App. 64 (2006); and Ingram v. Nicholson, Vet. App. No. 03-2196, (July 12, 2006)). These decisions appear to narrow the impact of Andrews but they may be trumped by Deshotel which was issued after both CAVC decision by a higher court, the Federal Circuit CLAIMS FOR RETROACTIVE BENEFITS WHERE THERE WAS A DEEMED DENIED CLAIM This type of claim presents itself when a regional office grants service connection for condition Y but the effective date established by the RO is arguably incorrect because the claim should have been considered by an earlier (non f…

More than 30 some years later, a small miracle looks near. After accumulating several major active duty stressors, under medical care for nearly 20 some years, I have now re-deciphered/recon'd to the VA RO a well defined diagnosis of my service connected "depression". Prayin' and lookin' for light in the upcoming season for Hadit members and their families, from mine to yours, cg.

hypertension Sleep Apnea
I currently have a claim pending for "sleep problems" as an undiagnosised illness associated with Gulf War service. Symptoms began in 99. Had difficulity sleeping with muscle aches, pain, fatigue, frequent waking during the night and just plain feeling like a Mack truck had ran over me during the night upon waking in the morning. Military doctor gave diagnosis of possible Fibro and "sleep difficulties". Complained during retirement physical in 2000 of same things - poor sleep, muscle aches, joint pain same Mack truck feeling. Diagnosis given was possible GW Syndrome told to follow up with VA. In 2002 it got so bad I could not sleep and I would wake up four or five t…

hypertension Nurse Practioner
What does everyone think about a nurse practioner that gives the C&P exam. I had what they call C&P for sleep apnea, heart problems including hypertension, gastreal reflux disease or gerd with hiatial hernia. All of these I secondaried to my PTSD claim. Well they blasted me on the secondary claims and hit a home run with the PTSD claim. The PTSD was done by a qualified psychologist and the others were done by a FNP (nurse practioner) who said that none of them were related. (WTF) I had other evidence that said they were but, this guy at the end of his statement said he had researched it on the internet and found nothing. I looked it up myself on the VA.GOV site un…

ptsd Recent Cavc Decision
My former vet rep might have handled this vet's initial claims- I recall the veteran and his wife complained to the main office of my POA and I heard about it all---- I was upset at the whole situation and mentioned it here-quite some time ago- The veteran, a Vietnam vet, was denied at the RO and the BVA for a PTSD claim because there was no current diagnosis of PTSD. I could not understand how a veteran could file a claim and then not obtain at least a C & P-to see if he did have PTSD and then to provide him care for it, as well as an established diagnosis. My POA is right at the Bath VAMC where the vet could have been told to enroll into the system to…

Question Regards Depression Proof From Va And Imo
I have been working diligently with VA, got the paperwork restating all my service connected background, its affect on my life today and a clear diagnosis for depression. This statement outlines medically over 25 years of misdiagnosis, with nexus provided by the VA with my current and clear diagnosis. With this data I can get the IMO that I need, hopefully a statement confirming the VA docs words. Question# 1 Any advice on how to "speak" to the civilian pysch to get the IMO confirmation to "restate" what the VA doc clarified? Question #2 How soon should I submit the newly clarified diagnosis for my current claim. or should I try to connect it back to my…

How Difficult Is It To Get A Zero Percent Rating?
I had a broken fifth toe in service (1989) and was wondering how difficult it would be to get a 0 percent rating for this. Would I need to have it xrayed to show that there are residuals? I've had pain in the past but treated it with Over the counter Meds.

T-bird --- Now My Id Is Messed Up
TBird, Something went amiss with the new upgrade. You now have me listed a "Chief Petty Officer" in my user id info. I was never in the Navy at all. When I signed on I input my data as a GySgt USMC. I spent 10 years, 9 months, and 22 days active service in the USMC. Please correct. Makes me wonder if all the other folks userids are messed up too. I see jstacy is listed now as a "Master Chief Petty Officer" too. What is going on with this stuff. You've got everyone in the Navy now!!!!! Edited: I just went through all the recent posts and threads since the new upgrade and yep!!!! Everyone is in the Navy now, either a Petty Officer 1st Class, Chief Petty …

Veterans Survival Guide
I got a book called "The Veterans Survival Guide". It is very good in describing the claims process. It has some good information on what to appeal when given an inadequate C&P Exam. It is very easy to read and gives step by step instructions on how and when to file a claim for compensation. I got it from Barnes and Nobel via their online store. I got a used copy for $12. The Author cites many claims where the C&P doctors did not have the veterans claims folder present and did not have the credentials to give an adequate exam. It is even worse than I thought, and he illustrates that the entire VA benefits system is incompetent and biased. I believe he work…
