C&p Results Came In Today
Hi to all I finally got a copy of my C&P results in the mail today. Who says the mailman doesn't ever bring anything of value? B) So many of you have been through the VA wringer and I am eager to here what you guys think of my appeal. The basic approach to my appeal is that I was SC for Pernicious Anemia with mild memory impairment and got 10%. The award letter explained that if I met the requirements below I would qualify for 30%. ptsd Ptsd Claim
I filled a claim for PTSD in March 06. A few months later they sent me a request for stressor letter and I sent them 3 which could easily researched and verified. I have a total of 10 stressor letters, I am waiting on buddy statements for a couple of them. The others they will not be able to verify as they were from working as a reserve police officer while I was on active duty. My service record documents document I worked as a reserve police officer and deputy sheriff so they will just have to take my word for those stressors that the military cant verify. Kidney Disease
I get 30% SC for chronic Nephrolithiasis: this is the rating they used Rate as hydronephrosis, except for recurrent stone formation requiring one or more of the following: 1. diet therapy 2. drug therapy 3. invasive or non-invasive procedures more than two times/year... Yesterday I had a renal scan and bottom line is my left kidney which produces all the kidney stones for the last 30 years is only doing 32% of the work while the right is doing 68% of the work. Hi everyone, its being a long time, came accross the decision Deshotel v Nicholson (What a piece of work by the VA against veterans claims). Sorry if this was posted before. This decision has the potential to turn the current non-adversarial Department of Vetrans Affairs (VA) claims adjudication process on its head as these two decisions could result in VA denying claims without making a specific decision and without providing procedural and appellate rights. ptsd I Got The C&p Report
I got the copy of my c&p report for my increase for ptsd. The exam was on oct 18th. gaf 45 and pretty much that i am screwed up. The doctor seemed to wright the report real good. Nothing in the report to question my increase. But I cant figure out why they are sending me to another exam. Still waiting for my awared letter from ssd. I will get that to the va as soon as I get it. Atleast the money is already in the account B) I know I am going to win my claim but I wish the va was like ssd. The waiting and playing games with the va is the hard part.

ptsd Ptsd Rating Appeal
As many of you know I have appealed my 50% rating asking for increase with IU. In the rating letter it was stated I was not in treatment at the present time. I got into treatment and the doctor has since wrote a letter stating I am totally & permanently disabled and will most likely never be able to work. He sent me to another shrink that could write prescriptions. The new shrink has put me on 3 med daily permanently. He has now written me the same type of letter. I am in treatment now with both shrinks at different times of course. My question is should I save this second letter of proof or have it put in my appeal file also? Guys I need your opinion on my husbands appeal claim. His C&P was Aug 9,2006 The Dr Stated the following right upper extremitity exam reveals he is not able to make any movement at right shoulder,right elbow or right wrist. He is not able to make any movement of right tumb or right hand fingers;not able to make a right hand grip. Diagnoses: by VA Doctor 1. http://www.vba.va.gov/pubs/forms/vba-21-4138.pdf When I was with the DAV, they always sent my evidence to VARO with this form in support of the claim. (I sent the evidence too on my own- just in case)I never saw this form until I got a copy of my c file.The DAV 4138s were in it. Since those days not all claimants used this form- as it is usually prepared by their Vet rep or NSO- BUT- in the 3 years I thought my vet rep was supporting my claim (NYSDVA) he had never sent the VA any 21-4138 at all-but my new (NYSDVA) vet rep does. tdiu Finally Got My Denial Letter From The Va
Denied for TDIU based on "wasn't shown you are unable to work based on SC disabilities". I don't get how I can fight this? I already SHOWED that. I've been out of work. I showed at my last job that I missed more than 1/3 of each YEAR due to my SC disability. With paystubs to prove it. (Showing short term disability and sick leave.) They've seen my GAF score which hasn't been higher than a 40 in three years. They have my hospitalization records, which show I've been hospitalized 7 times in three years. Using Form 21-4138
I noticed a posting about this form and had a question. Do you need to send in this form along with each piece of additional evidence? If so, why or does it help you? I started my claim late last year just with a letter to the VA asking for an increase of current disabilties as well as additional secondary service connected conditions. I have sent additional information to them, medical, etc. with only a letter from me on top of all evidence. I am on my second VCAA notice and the only time I used this form was to give them local VA information of where my husband had treatment.
