ptsd Brain Volume Loss
I wrote a couple of days ago about my CT an the matter of my losing Brain Volume. I went to see a VA Neurologist,this past Tuesday. She says it is nothing to worry about,and said a lot of nothing. She stuck a needle in my scalp a few times,then on my legs, An guess what?? She also says that the medicine could be the cause of my losing Brain volume. Too much medication working against each other. She showed more interest in my hands,legs,and feet then in my Brain. I have Peripheral Neuropathy,stocking & glove- at this point mostly the problem is in my feet-legs. I live in constant pain,even taking up to 6 Loratab 10 a day.Was on 3000MG Gabapentin(Neuro…

Should I Request A Copy Of C-file
i have been told my claim is at the rating board. i would like a copy of my c-file to make sure everything is there. or do i wait since it is at the rating board. i dont want to hold my claim up but also want to make sure my evidence is in my file.

For Vets Who Increase Above 50 Percent.
Please be aware that when a Vet gets increased to 50 percent , They are usually placed in priority group one. Once the 50 percent plateau has been reached the Vet can do the following: Apply to the VA to have Pharmacy Co pays refunded to the Veteran back to the effective date.

Fight Now Or Wait
Question: If you receive a copy of the exam findings and report that was done for a RECENT C&P exam, and you don't agree with the medical opinion or findings, should you send in documentation right away (even if the file is a the rating board) or should you wait until the claim is rated and then appeal the findings? Husbands recent C&P was lacking on the findings for PN in hands and also incorrect statements regarding legs and feet (not accurate). Thanks for you imput, Jangrin B)

Va Medical Opinions
On my husband's inital cancer case - he did not SEE the VA examiner. The examiner just issued an opinion. According to the BVA Handbook -- the veteran is supposed to be notified when a medical opinion is requested --and also is to be given a copy of the opinion and time to respond before deciding a case. Does this also apply to the RO?? Is it the basis for a CUE if a decision was made without notifying us that an opinion was requested or providing us with a copy? Is not affording a veteran due process the basis for a CUE? The VA examiner used a C&P exam report -- but my husband never SAW him --and he stated that he was asked to give an opinion after revie…

Lottery
I will be stoned for what I am about to say but I have never won a popularity contest. It leaves a bad taste in my mouth when people act like they have won the lottery when granted a disability award. This is evident at all vet forums not just here. I know it is a long and torturous process from personal experience and everyone should feel relief and joy at finally getting the "Envelope." But when folks say "now I can go buy this and that toy" it doesn't sound right. Almost like they beat the system out of something... If The Ro Cues Itself...
I have read some posts in here about the RO CUEing itself. I also read sometime somewhere in the M21 that if a claim had a clear and unmistakable error --the RO should correct the error. So if you reopen a claim --and point out a significant error made in the adjudication of the original claim (especially failure to adjudicate it at all......but also other errors) AND the RO acts on that error --and adjudicates it...(or corrects whatever error you point out... Would that have the effect of possibly arguing for the effective date should go to the original date of the claim? Cpap
I keep hearing on this board about the cpap and how usually when service connected its 50 percent. Is this true? I have a claim for sleep apnea and I have been using a cpap for quite a long time now and very shortly im supposed to be rated for this being that ive been to the C&P for it. Should I expect 50 percent or less dependent upon the number of my apnea scale. I would think that if you had a 20 on the scale you could get more then 50 percent. Mine is only a 6 which they say is low but, still sleep apnea is evident and been diagnosed and I wear the CPAP at night. ptsd Crunch Time -nod Or Not?
Soon to be 1 year from getting my upgrade. I went from 40% hearing to 50% hearing, 70% PTSD/MDD, 10% tinnitus, 10% lknee injury and 10% l knee degenerative osteoarthritis. I was denied 10% for chronic otitis externa. I thought it was a well documented claim. A VA ear, nose & throat doc's records that I submitted said "...l otitis externa, most likely from the ear molds (hearing aids)...stuck in a chronic state...). I had an IMO from a doc who treated me for the condition a couple of times. The VA sends me a prescription every month to control it. The C & P examiner was very hostile. ?at Rating Board? Again?
OK let me get everyone up to speed on this... I have appeals that have been remanded back to VARO since October 2004, also I have new claims from March 2005. Several times in the last 12 months 800# has said your claim is at rating board only to be disappointed. I had 4 C&Ps in July and one in August of this year. Ok couple weeks ago they said claim was back at development and now as of today they say the claim went to the Rating board today. Could it possibly be close to the end of this agonizing experience. How much longer could it be to the end of the process?
