Examiners Will Not Follow The Remand By The Bva.
John, I called the AMC and they said that they had total jurisdiction over my claim and could order another C&P if needed. Is this true? Does anyone know. You have been following my post and I am sure you are aware of the circumstance of that particular C&P. I didn't think that they two crooked psychiatrist would give anyone their etilogy for any new evidence or that examination. Thanks, Josephine

Does Amc Have Complete Jurisdiction?
Does the AMC have complete jurisdiction over your claims file. I called them today, concerning the two psychiatrist not giving their etilogy of the C&P examination. I was told that they can if they wish order another C&P . I do not want to be remanded around and around. Some have expressed only your R. O can order C&P's. Thanks Josephine

Checking Claims File On Line
JohnM, When we have checked through the IRIS system, the email response from VA has been the next day usually within 24 hours. And one time we requested by email and they telephoned us back and spent some time on the phone with us. The seemed to be able to look in the file to see if things we had sent were in the file. I think the email system is better. JMO Jangrin

Hearing
So I have asked for a hearing at the local RO. I was shot down at the intial claim and then at a NOD with DRO. My FM9 is in and I have rebuted the SOC. I am trying to understand what to expect based on previous posts here. However, if anybody wants to chime in and let me know I would appreciate it. I have contested three medical conditions which of course I believe should be SC'd. For those of you who have followed my case you know I am looking at a hiatal hernia, Plantar Faciitis, and Raynauds. It will be intreresting to find out what is determined.

So...a Waste Or Not?
I am going to drop my AL SO tomorrow morning because he has done nothing to help me. I`m curious as to how you all feel about service officers. I feel a very good one that has compassion could really help your claim, especially being they are in the same building as the VA RO. I`m sure they become friends with the raters etc. Is there anyone out there that knows a good SO here in the Detroit area? Please give me their name if so. Cavman

How Does Va Rate
Vike 17, Berta, Allen Do any of you (or anyone else) know if the va actually rates spinal stenosis or spondylitis seperately from degenerative disc disease. I was informed by a PVA service officer that stenosis warrants a seperate rating.. I have been rated for DDD with siatic nerve damage with foot drop since 1999. Althought my MRI's, CT's and melygram show spinal stenosis, spondylitis and arthritis I was not rated for these problems. According to this service officer the foot drop warrants a 30% rating as well as the K award. I know these all have seperate codes, but title 38 does not really indicate what are the high or low rates for the problems.... Am I m…

I didnt want to go into too many details but I beleve there was a hint in there somewhere, Someone correct me if I am wrong as it may be just anxiety mixed with a dose of wishful thanking.

Up Date On Post Imo Against Two Psychiatrist
Remand states- After the above development has been completed, the veteran's claims file should returned to the board of VA psychiatrists who participated in the April 2005 examination for clarification of the provided opinion. They should be requested to review the record and reconcile their opinion as to etiology in light of the evidence added since their examination of the veteran, including the May 2005 statement of Dr. B C. C and the January 2006 statement of Dr. M P. This is what the two psychiastrist wrote as an answer to the remand of the BVA. I picked up a copy today.
