Have You Ever Heard Of This
I have a couple of questions. I was rated 10% for migraines in 2004. Filed a NOD and was denied for lack of evidence in 2005. Jan 27, 2006 filed another NOD with stronger evidence. On May 31st. went to a QTC exam. July I was sent a letter for IU I want to know has this ever happened to anyone else and is this a good sign. For migraines all you need for IU is 50%. How long does it take to receive benefits after you have sent in a IU form thank you for any help

Question Amended Claim
Can you ask for your claim to be amended to include new diagnosis. Like for instance if you were misdiagnosed as something else can you ask for an amendment to your claim.

I recently filed a Reconsideration request on a CUE denial- The denial was not based on established VA case law-at time of CUE- and some of the statements were ludicrous in it- they gave me my appellate NOD rights etc--- The denial was on June 30,2006. The VA keeps telling me I have no claims there at the VARO- they are all at the BVA-the CUES are gone The BVA just told me they have two claims but not the CUES- My local vet rep said he cannot do anything to check this CUE matter out-he has no contact with them at the VARO- He told me this when I got my sameo sameo DRO review- but his boss stepped in on that at the VARO level- This is something the local …

Service Medical Records
I am retired Army National Guard, served in ODS. I filled a claim for an accident that happened while on training. What gets my goat is "my letter stated no record of Cervical Radiculopathy in SMR. This claim was denied. WEll, of course there is no record, the guard keeps only military records in there files. Any goof ball can tell even my civilian doctors stated: Cervical Radiculopathy due to neck injury from MVA. The guard is at a disadvantage when it comes to medical records. I just had to vent cause I'm sick of hearing no record of (whatever) in SMR. Looks like the VA would realize most medical care for the guard is civilian!!! Thanks for listening.

38 Cfr Question
Where in 38 CFR can I find information on the fact that the date VA receives a claim is the date of the claim. ie.. they received my back claim on 2 Feb 04, denied in July 05, Nod sent Aug 05, SOC and rating for back received in Jan 06, (10 percent), and they established the effective date as of Jan 05. Don't know how the he!! they did that but I need to send a NOD for earlier effective date (2 Feb 04). I have look all over until I am blue in the face but can not find the info needed to support my claim. I know it is there and I am simply wound up and just missing it. Thanks Ricky

Time Table
My husband received the call yesterday that he was rated temporary 100% and should be getting a letter within a week to 10 days. How long from now should we expect to wait before receiving a check? Is it direct deposited? His previous guard checks and active duty checks have been direct deposit so will they automatically direct deposit his disability checks? He's supposed to get back pay since March. Will he get a lump sum check or will they break it down? This is all new to us and we have so many questions. Buster's wife

ptsd How Long Will I Be Paid Smc "s" For Prostate Cancer?
I am 100% PTSD (TDIU) & also have SMC "S" for Prostate Cancer. I have completed 43 radiation treatments months ago. How long will the VA pay the "S" award? I know people that seem to have the award forever & others that are cut just months after treatment. My doctor says will be 5 years before we can say I'm really Cancer free. Is there some regulation that would help me understand what's going on. I, for sure am not going to ask the VA . To keep the award, when they drop 100%, you would need 60% + the other 100%. Crsc And Crdp
CRSC took effect June 1, 2003. Initially, payments went solely to active duty retirees who applied and were deemed to have combat-related disabilities rated at least 60 percent disabling or disabilities for which they received the Purple Heart. Eligibility later was expanded to any retiree having a combat-related disability to include reserve component retirees. CRDP took effect Jan. 1, 2004.
