On March 20, 2006, Dennis Morgan, through counsel, filed a petition for extraordinary relief in the nature of a writ of mandamus. The petitioner requested that the Court issue a writ ordering VA to stop seeking medical records, and requesting an immediate VA examination. Petition at 6. On May 2, 2006, the Court denied the petition, citing VA's discretion to develop evidence with respect to claims. One More July 2006 Cavc Decision
http://webisys.vetapp.gov/isysquery/irld967/26/doc in part: "Although we find clear error in the Board's statement of reasons or bases, we cannot at this time conclude, without sufficient evidence as to whether it is possible that Mr. Roper's level of hearing loss could have causally contributed to the force at which he turned and disabled his knee, that only one permissible resolution of the matter exists, namely reversal . See Pullman-Standard, supra. Accordingly, we remand this matter to the Board for further proceedings consistent with this decision." The court states these claims issues have been pending for 14 years already-and "III. CONCLUSION Upo…

ptsd Interesting Bva Citations---
"The duty to assist is not always a one-way street. Woods v. Gober, 14 Vet. App. 214, 224 (2000); see also Hurd v. West, 13 Vet. App. 449, 452 (2000) (veteran cannot passively wait for help from VA). " The veteran had filed this claim prior to the VCAA however the VA did give ample notice of want he needed to prove his case. "The Board also notes that the United States Court of Appeals for Veterans Claims (Court) has held that the plain language of 38 U.S.C.A. § 5103(a) (West 2002), requires that notice to a claimant pursuant to the VCAA be provided "at the time" that, or "immediately after," VA receives a complete or substantially complete applica…

Hi, I am rated at 100% due to unemployability due to my s/c disability, effective date 12-01-04. In trying to resolve this owing the VA 8000.00, my VSO told me that the 100% wipes out the severance pay issue. Has anyone heard of this? Thank you all. HolliG.

Options
Hi everyone, My husband spoke to the people at RO in Connecticut. They connected him to a supervisor, who he questioned as to whether they received his NOD on his 1948 claim. She said it was with the Appeals Department and that she would get his file and look and see if it was in it and call him back on Monday. A half hour later she called him back and stated that she had the file and that she was going to send him a letter out today, which will give him options as to what he would want them to do. She even mentioned that one of the options was if he wanted to go to trial. He forgot to ask what the other options were. My question to all has this been done t…

Family Tree
I have a question, maybe someone can help with. My wife and I went into our local VSRO yesterday, being I had a dental appointment. This concerns one my wives uncle who was in ww2, and got out on a medical discharge. They found him out in the jungle more dead, then alive, suffering with malaria, and who know what else. he was in Guadalcanal (spelling) and also survived the Bataan death march, but when he got out it had affected his mind, so he never applied for any disability, and didn't want anything to do with the VA. he was drafted out of MN, live here all his life, except for the time spent in the army, he died in 1979 at the local VA hospital, he got 100% service-con…

(from email I just got from Colonel Dan-Berta) http://hepatitisdoctor.com/ Dr Cecil is one of the experts I have used for several years to answer questions on Hepatitis. a lot of info at this web site, besides the petition to sign.. sign in. also send a note to your congressman http://www.march-on-dc.com/Petiton/DrCecil/signaturesBC.asp I get email from veterans all over the US with HCV who are refused treatment by their local VAMC. Seven percent of veterans are infected with HCV and 10% of Vietnam era veterans are infected (10% of 8.5 million Vietnam era veterans = 850,000). The VA plans on solving this problem in the year 2025 when most of the…
