From Col. Dan
(From email from Col Dan Cedusky) I strongly disagree with the DAV and other Vet orgs on this matter. I urge you to please SUPPORT H.R. 4914, AND S. 2694. Veteran's ought to have the option of hiring an Attorney. The process is NOT open, informal, and helpful to veterans. The system is full of government "red tape" and lengthy litigation. Claims go on for years. Many VSO's are not responsive to veterans, many VSO's are not trained properly. Many are just the middle man, passing veterans's forms, letters, files on to the VA, and not telling the veteran what is needed. The last unhelpful conversation I had with my DAV VSO, I got so angered by his l…

When Do We Hear Something?
Good Morning Everyone, B) I (we) are fairly new to this board and the VA compensation and claim process as well. Sooo these past few weeks of waiting to hear something from the VA has been spent reading the posts here at "hadit". It is certainly a learning process. Thank you all for your imput on the topics presented here, as those of us new in dealing with the VA would be totally lost without you. Does anyone know what the "average" time frame is until we hear something/ anything from the VA regarding an initial claim. And does anyone know how long social security takes to process an inital claim for SSD. Also, when we do hear something, what is the next step…

De Luca- Pain Ratings
Someone the other day mentioned the DeLuca decision as applied to their claim- Basically this explains it and how the VA applies DeLuca.(from:http://www.va.gov/vetapp06/files2/0607373.txt) C. DeLuca and extraschedular considerations Functional loss due to pain under 38 C.F.R. § 4.40 (including pain on use or during flare-ups) and functional loss due to weakness, fatigability, incoordination or pain on movement of a joint under 38 C.F.R. § 4.45 must be considered in the case of disabilities involving a joint rated on the basis of limitation of motion. See DeLuca v. Brown, 8 Vet. App. 202 (1995). Although the veteran has intermittently sought trea…

22,000 Possible Victims
I see the VA is pooh poohing the chance of vets getting hep C or HIV from unsterile prostate biopsies. Now they say no one has anthing to worry about. I read this in the Tampa Tribune today. 22,000 vets were possibly affected. I am not even sure I want a flu shot at the VAMC anymore. Can it really be this bad? If they drill my teeth am I going to get HIV because someone forgets to sterilized the drill?

C&p And Your Claim File
Had three C&P exams two weeks ago, ALL with MD's contracted by VA. NOT ONE OF THESE FOLKS HAD MY CLAIMS FILE!! The Internist who I learned later will actually gather all the results and write the report to the VA, told me that they (MD's contracted by the VA)were not supposed to have my medical records so THAT they (she) COULD GIVE A TOTALLY INDEPENDENT AND OBJECTIVE EVALUATION!!!! What do you all think of this B.S????? I have a pacemaker ( clearly indicated in all my claims paperwork and notede visually by the technician) but they wanted to give me a treadmill stress test!!! Now, any first year med student will tell you a pacemaker and treadmill t…

Va Followup On Claim
Hey all like the look of the new site. I received a letter a couple of weeks ago that the va was going to require me to go thru a new c&p exam. 2 years ago I was rated 80% paid 100% PT individual unempoyablity. Now they are openning it back up and are going to require me to take another round of c/p exams . Is this normal ? How often can I expect this to happen? Thanks chris
