1151 Denial
After years of waiting I finally got a denial on my 1151 claim today. The denial was based on the fact that I had a cataract that caused loss of vision prior to surgery and the fact that I am now permanently blind in that eye they said there was no increase in disability since I had no vision because of the cataract prior to its removal and no vision now therefor no increase. I almost laughed at their reasoning. A cataract is not a permanent eye condition but what I have now at their hands is. Oh well what else is new with them. Have a NOD written and will send it in Monday. This is one fight I will not let go of. I know there are BVA cases where veterans have had cata…

ptsd Denial Reasons Varo Cant Use
I am currently fighting to regain my PTSD service connection after VARO claimed CUE on itself. In my research I found some info that may be of use to other vets even if it doesn't apply to my case. The VARO can not deny a claim using the following reasons (I'm sure Berta or someone will correct me if I'm wrong): 1."VA does not accept medical opinion based only on reported history and not supported by medical evidences of record." Wrong According to COVA case Sheets v Derwinski (1992) and BVA case Docket No.: 97-06 643 A(Aug 2005) yes they do. (In fact according to their own form letters they do, it's called MEDICAL OPINION) 2. Denial claiming your evidence is "no…

Dav Response To Veterans Commission Review
Greetings to all, This just out from the DAV. I contacted the Rep: Steve Buyer from Indiana who appears to hate veterans. His office will not even respond to this issue. I feel that in it's self is a small victory. I informed the receptionist Mr Buyer has woken a sleeping giant, and how can Rep. Buyer sleep at night knowing what he is trying to do to the very men and women he has sworn to protect. More on this issue go www.VAwatchdog.org, or www.DAV.org. God bless you all.. When Do You Get A Soc?
I CUE'd an old decision and the CUE was denied. Then sent in a NOD. Thought the next step was to receive a statement of case but got a letter from the VA telling me that I can request DRO review or the Traditional Appeal Process. The letter didn't mention SOC in relation to the DRO review at all. I thought you automatically got a SOC when you appeal - DRO or BVA? At what point can I expect one?

ptsd Ptsd In Iraq And Afghanistan Vets
I think they are finding more PTSD now in the younger vets because they are screening for it. After Vietnam the VA did not even acknowledge it. I wonder how many vets would have screened positive after Vietnam? Think of the many thousands who never got treatment until they broke down years later. What a waste.

tdiu Need Advice
Hi everyone, I'm scheduled to go and see an Ortho doctor in two weeks, The doctor is a retired army Ortho surgeon. He was the Doctor that helped my brother get his TDIU and did the surgery on him. VA respects his decision when it comes to disability. to give everyone a run down on my condition, I'm getting 30% for PFPS for my left and right knees, I was graded as 5257, and this was many years back. Now, my right knee has osteoarthritis, I have GERD, and I've got (according to the civ Doctor report) Cronic degenerative Disc disease in my lower back with osteopenia above that soon to be osteoporosis if i don't get my calcium under control, I've been taking fosam…

ptsd Nod
I sent in a very detailed NOD on a 30% PTSD award I got. I recieved a letter from the VA asking if I wanted a DRO or the normal appeal. I replied that I wanted the DRO. I called the 800# to make sure they recieved my correspondence---they did. The person I spoke to said they have 4 DRO's and it would be twelve months bsfore they get to mine. My question to all of you is this---I go to the VA regularly for PTSD groups and individual counseling. Should I send the VARO copies of the results of these sessions during the next twelve months? Thanks.

Va Dentist
I went to the VAMC to have my teeth cleaned and examined a month ago. Because I have a implant I had a private dentist look at my teeth a week ago. She look at my teeth and immediately discovered a problems with one of my crowns. We are talking at least $750. I had this verified by my other old dentist. I would like the VA to do it since I can save some dough but they already missed it once and I find them untrustworthy. I am sick of shelling out money to do things the VA should be doing. Any suggestions?
