Please I Need Help, Questions
Hello all, first time poster, former looker from the outside, now registered Ok here it goes...short as possible, I have 20%, 10%for tinnutis and 10%PFPS of Right knee. I was originally denied for hearing loss, tension headaches. In August of 05 I requested my case be reopened because of hearing loss: when I was intially seen for the hearing loss in 00 I had a PE tube in my ear and the va found that my hearing loss was within normal limits, since then the Pe tube has come out, and I can barely hear on one side. Also since the onset of my knee injury I have had moderate depression, though I was not treated while in the service, I was within one year treated by a family …

Question On Rule Of Law If Any,
It has always been a question in my mind, as to how the VA can rule an injury, that is clearly documented as having occured while in the service and having been the reason for the Veterans discharge, at the recommendation of a P.E. Board and/or Medical board, being released from service as unfit for further duty or medicaly discharged for same, whether it be rated as 0% or 100% disableing at time of discharge, should not have been found service connected. Why then may the VA find the condition as not service connected, without first showing that the disease and/or injury having already been diagnosed and for which veteran was discharged for, was clearly and erroniously…

Not saying that you other vets can't help of course you are invaluable. I just remember when I was first getting PTSD treatment it was tough for me to go to the Vet center. Sean

Adaptive Grants - Various
OK, I want to share a success story I suppose and also remind others about these programs. Starting with the adaptive vehicle grant. This is a grant for persons suffering from the loss of use of one foot or leg, and other stipulations. The most up-to-date info page I could find was here: http://www.vba.va.gov/ro/hartford/CandP/Autogrants /AutomotiveGrants.htm The basic entitlement amount has been increased to $11,000, and can be used to purchase any type of vehicle. Basically you file the form requesting the entitlement, and then the VA loses it for 2 months then you resubmit it and they take 90 days to process it, so its about a six month ordeal. However, th…

Link For Principles For Rating And Service Connection
Here are two links that shows principles for rating. The second one has good information about pre-existing and aggravation of conditions in service. http://neds.daps.dla.mil/Directives/1850/9000.pdf http://neds.daps.dla.mil/Directives/1850/3800.pdf One of the rating principles surprised me, as we have discussed PFTs often on Hadit. I am working with a vet who had normal elements of the pulmonary function tests, except a DLCO at 60 (I think that's the acronym) which, if rated alone, would have been a 30% rating instead of 10%, had it not been for this rating directive, which is in one of the above documents and was cited in his decision: d. When there is disp…

M21-1 Mr, Part Iii, Subpart Iv, Section H
a. Considering a Change in the Diagnosis of a Psychiatric Disorder. If the diagnosis of a psychiatric condition is changed, return the examination and any appropreate records to the examiner to determine whether the new diagnosis represents: Progression of the prior disorder Correction of an error in the prior diagnosis, or Development of a new and separate condition. Reference: For more information on the diagnosis of mental disorders, see 38 CFR 4.125 Diagnosis of a Mental disorder. If the VARO is held to this, then I see no way that they can deny my claim for an Acute Schizophrenic Episode, in remission, demonstrating moderate impairment for future …

Full M21-1 Rewrite Link
You guys may already have this, but I just found it. It says it's the "full rewrite" (whatever that means) of the M21-1. It includes changes made today. I like how it navigates, and "Ctl F" lets the user find something specific. http://vbaw.vba.va.gov/bl/21/M21-1MR/m21-1mr_main.htm Merry Christmas to everyone! Carrie

diabetes Bilateral Tinnitus
Hi to all and a very merry Christmas. I am looking for veterans who served at Lakenheath AFB in England during the years of 1964-1967. I was a jet mechanic and have been diagnosed with bilateral tinnitus and denied benefits for SC. Also denied for diabetes, peripheral neuropathy, memory loss, also have a carotid body tumor. My SO asked me to get in touch with anyone who worked on these aircraft back then as the aircraft came from Vietnam and were likely contaminated with AO. We have other veterans here in Southeast Texas who claim the same but can't get the VA to acknowledge this. If any of you were at this Air Base back then, please get in touch with me so we…

Need Help Filing A Cliam Under Section 1151 (berta)
Greetings, Due to the issues of side effects I now must endure some are severe from medications perscribeed by by my VA doctors. This issue was brought to the VA Medical Attention from an outside doctor that examined me. He could not believe that the VA perscribed me 19 medications. I feel I have no other choice but to file a claim under section 1151 due to the VA's continueing ignoring my side effects issues. My clinic called me today; my main providers nurse and said they received the information concerning my severe side effects because the VA did not regulate my medication (they did not check the drug to drug or Drug to diease effects) she informed me that my d…

800 #calls From Ny City
due to the New York City transit strike- hopefully this is only temporary- The VA has issued a SSOC to me- dont have any idea of what is what yet- This makes sense as the SOC I got in Sept was deficient and they then considered the evidence after I got the bad SOC and raised hell-but I dont know if it is an actual decision on my claims, or a correction on the other SOC. I want to read it myself-dont want the local vet rep I have to read it to me-I can wait for it in the mail- I have 2 NODs tentatively prepared-printed off the regs already- more IMO docs to contact if needed, additional medical evidence to submit with any NOD - a subpeona request if needed…
