Is Their Such A Claim Involving Error?
If a Veteran submits an Appeal of a previously denied claim, questioning the inadequecies of the VA Examiners examine, be viewed as an informal CUE claim for the inadequicies of the VA Examiners Exam and subequit Report for Adjudicational Purposes? Should this informal CUE have been addressed in the SOC and if it is shown that it wasn't, would this be considered an open claim? Jim S. B)

Annerversy Date For Actull Va Tortour
Dear Fellow Veterans & Friends. In the 1980's a book was written about seclusion and how it was being used by Dr's against pt's they did not like. In Dec of 1980 I was locked up in a VA seclusion room for 7 days, Taken off all medicatons. Denied any human contact, Just a plastic matterest on the floor and no pillow or blankets. In a small room that allowed the 5 above zero Minnesota winter to cool the room to around 60 above. I have never shared this abuse with you because even after all these years it still very painful to talk about. But you all know the VA has for years been trying to break me so what I have to share now should not be to much of a s…

tdiu Claim At Raters
I received a call from the aide at my congressman's office this a.m. saying that the only thing holding up the final rating of my claim was the VA 21-4192 from my last in employer (Fedex) in 2001. I had requested that my claim (filed) in May 2005 be given a financial hardship waiver back in the beginning of Oct 2005, and the Seattle VARO sat on it til a week ago Monday when I called Rep Jay Inslee's office and sent ANOTHER copy of the disconnect notice for my electricty. Does this sound like I might finally get my TDIU ?

ptsd Understanding Rate Tables ?
I was recently awarded 50% for PTSD and I'm trying to figure out whether I am entittled to anything add'l because my Mother lives with my Wife and I. The chart has a catagory for "Veteran w/ spouse and one parent" and its appears I am entitled to an extra 46.oo but there are no requirements listed for her eligibility. She's elderly, collects SS and has 140K in the bank from the sale of her home. She is not dependent on us for financial help since she collects SS and has money in the bank so I assume I am not entittled to the extra $$. I called the VA and my NSO and I can't get a straight answer. The form for applying is 21-509, Statement of Dependency of Parents and its …

Letter Received From Va
My husband received a letter from the VA today about the 1151 claim he sent in. The letter looked like a standard do you have any thing else to submit and sign this form and send back. However, at the bottom they had cc to American Legion. Why would they just send a copy to the American Legion? He has not contacted them for anything. Thanks, sbrewer

ptsd Reevaluation--ptsd--100%iu
I am new to hadit, but have been visiting the site for a few weeks now. Hope I am posting properly. Here Is the condenced verson. After many years of refusing to acknoledge my PTSD symptons, I decided to contact the VA. I applied for service connected disabilities for PTSD, Hearing loss, and Tinnitus on Jan.10,05. On August 26, 05 I was awarded S.C disability for PTSD ( 50% ), and Tinnitus ( 10% ). Total disability rating by VA @ 60%. Since I have not been able to hold a job for any length of time due to PTSD, and had been unemployeed for over a year, I filed and completed forms 21-4192, and 21-8940. On October 28, 2005 I received notification stating " WE GRANTED ENT…

Claim Status
My husband called the Virginia RO this morning to find out what the status of his claims were. They told him that they were with the rater. He was told this same thing several weeks ago. Also, not to expect anything until after the first of the year as they had a lot of people out due to the holidays. So, I guess any hope of getting a response for anything from this office until after the first of the year for anyone is probably hopeless. Also, if it is at the raters desk, is this a good sign or do all claims whether they are denied or approved go to the raters desk? Thanks to all and Happy Holidays.

Complicated Smc And Eed Question
The SMC regs say if a vet is entitled to SAH, he is also entitled to corresponding SMC level, and vice versa. Loss of use lower extremities is an M level, I think. My question is, if the loss of use alone qualifies vet for M level, would that mean this should be rerated starting with the M level, then adding another single SCD at 100%, other SCDs combined at 50% or more and A&A? Vet also has one K rating. If this can be reconsidered I believe vet's rating should be at N1/2 + K, which I think now qualifies the vet for the R1 rating if skilled care is ordered. (It is.) Can anyone help me with this?
