Duty To Assist?
Question: Is it required of the VARO AOG, under the Duty to assist Veteran in proving his claim, to state what evidence is required to rebut their use of an alternate diagnosis, that is used to deny Veteran claim? If I have continuelly applied for SC of a psychiatric disorder, and they claim it is a personality disorder, must they state as to what evidence would be necessary to rebut the personality disorder as wrong or since it has been some time since last C&P exam, provide you with one? Called Bva Again Judge Has Made No Decision

I've Got A Question.
Okay, here's the problem: I turned in a claim for osteoarthritis of my hip and knee. Here is the way that I worded my claim: "Please consider this as a claim for disability concerning my left hip and left knee, which are causing me pain and the inability to sit or stand for any length of time. This also keeps me from bending or flexing my back and causes me chronic pain in my knee, especially when trying to walk and both of these problems cause interference with my daily activities. Soc Evidence Not Listed Yet Submitted
I have searched for this topic and I can not find an answer... When you submit medical records to the VA for a claim and that evidence (medical records) is not listed on the SOC as part of the evidence used to determine your claim... and your claim has been denied or an increase not granted for a condition already service connected by the VA... can you re-submit that evidence ...to support why your claim should be granted or increased? if that said evidence clearly supports a higher evaluation. Or would the VA state it is not new evidence? trying to get all my ducks in a roll... MT

Reconsideration Request Is
just go to the BVA web site to see what I mean- If a veteran does not file a formal NOD within one year after their decision -whether they file reconsideration request or not- they 'more than likely' have lost their EED and appellate rights. There is no reg that says a Recon request is a NOD too. I posted some time back a case where the vet filed recon request but no formal NOD- however his Rep had filed a NOD for him- it was the only thing that saved his appellate rights and preserved his EED. That Rep outta get a Gold Star for saving this vet's claim.

Ssa Must Be Running Scared
Went to Social Security Admin. Office today and asked for a copy of my award letter and reasons for my award of SSDI. The letter stated when and how much I was getting, but the reasons for their decision to award me SSDI is only listed with a DIG & SDIG code number. DIG 2780 and SDIG 7150. When I told them how am I supposed to know what these codes ment, or how I was to let my Dr or Psychiatrist or even the VARO on a claim I was working on. The clerk told me that the VARO would know what the Codes mean. Why wouldn't they tell me? Are these Codes so imflamitory as to my mental statis that they must keep me from directly knowing what they mean? Will a FOIA do me …

Va Shrink Screwing Up My Claim
hi, I think the va shrink is trying to screw up my claim. I'm 10% for anxiety and, I recently got a copy of my medical recored, and she says that I always had this since childhood and that I was a fussy and fitful child. which is all totally wrong, I wrote her an email telling to change this because I never said that, I said when I was young, I was sometime a little on the she side, but never had anxeity when I was young, Do the VA shrink try to do this to screw up claims or what.
