Cue And Eed Claim
A friend I helped got 6 years retro 100% some time back- I prepared an appeal for better EED- he then got 4 more years retro- at the same time I prepared a CUE claim on his initial denial-denied 27 years ago- The BVA just made an interesting decision in a remand- they remanded the CUE to the RO ,stating if the CUE claim is successful, the EED claim is moot- (RIGHT!)I thought the RO was working on it all this time ! ALso they said the CUE should be addressed before the EED claim is--- but the VARO (Buffalo where this crap is SOP) failed to send him a VCAA letter- which I just found out on the EED claim-(CUES dont get VCAA letters but if they send you one by …

Bva Judge Has Reviewed My File?
I just called and spoke with the Director's office at the BVA. The Judge has reviewed my file and now it has gone to Para- Legal. Anybody know what next and why? I am loosing my mind over this claim. Thanks, Betty

Cue?
This is the first rough draft of a cue letter. Does any one know of further regs or court cases pertaining to no notice of determination sent to veteran. Cue 1. The VA did not send me a notice of a decision or of my appellate rights after my October 11, 1973, Veterans Affairs, Compensation and Pension exam. I believe this claim from January 1973 is still open because I never received a decision that I could file a Notice of Disagreement. I have a complete copy of my claims file and there is no notice of determination in there. Question About Reopened Claim?
I'm hoping to get an IME/IMO from my VA Psychiatrist. Of course Hope is a big IF. If I do get the IME/IMO and I am able to open my previousely denied claim and they procede to deny the claim, still using the alternate PD diagnosis to deny my claim. Will I be able to claim some type of error, since the evidence they proport says that the VA examiner made an alternate diagnosis, or maybe I will be able to show how this evidence is deficit the proper certification that the original diagnosis was worng. That their denial is based on a VA C&P examination that is insufficient for rating purposes? Rockhound :)

Nys Vets On Nysdva Poa
I named the former director, George Basher,NYSDVA, in my OIG complaint in Oct 2007. Their state web site is in process of being re-done and they have a new director-appointed by Gov Spitzer on Nov 12, 2007.Colonel (Ret) James MC Donough Jr. I had to update some info with the OGC regarding a veteran who I also filed complaint in his behalf on- so I need to keep them up to date-they definitely probably know of this change already at GC but I just found out- does anyone know where George Basher went? I had complained to Governor Spitzer about him but the letter in response from the state Capitol office did not seem to indicate that they did anything but discuss …

ptsd Case Sent To The Rating Board
Iam 70% sc for ptsd and 40% sc for hearing impairment, 80% combined. Have applied for TDIU, my claim has been sent to the rating board. Is this the final step or is their more to come. I also had two c&ps one for hearing and one for employability done in Jan. 8 2008. Thanks for your response.

Interesting Cue
from:http://www.va.gov/vetapp07/files3/0722335.txt "ORDER The July 1988 rating decision which denied the veteran's request to reopen his previously denied claim of entitlement to service connection for a right testicular disability on a secondary basis was clearly and unmistakeably erroneous. The CUE claim is granted." There are 1151 CUE claims decided by the BVA for 2007- and they dont have all 2007 decisions posted yet- certainly some of them have been granted. This one might involve only a small rating- but almost 20 years of retro makes it a great outcome for this vet.

diabetes Voc Rehab And Iu
I am putting together my claim for IU, not working with a VSO, currently 70% PTSD, 20% Diabetes. I attend to weekly group sessions for Ptsd and am getting a letter from my counselor which will state in part because of PTSD I cannot get a job havent worked since 2005. also the C&P statesbascially it is likely my PTSD caused my unemployability See a VA Psych Dr every couple of months take 3 different types of meds. GAF 46, Question Do I need a Voc Rehab letter if so how do go about getting one Thanks

Hi there, I'm starting to notice how threads begin. They are listed with a certain topic to start the thread and before you know it, the thread has encompassed 4 or 5 more topics.
