Sc For Injury Caused By Meds And Or Other Sc Condition.
Thank you in advance for your time reading or replying. Sorry if the Topic Title is confusing. Here is the situation: I am a Vietnam Vet that has a combined SC rating of 70%. I have SC DMII, Left and Right Leg Peripheral Neuropathy, Diabetic Retinopathy, Gastoparesis, and Several SC Heart Diseases. In July of 2006 I was visiting my son in CT for the month. One day while watching my grandchidren play in the swimming pool, I got up from my chair to do something, and lost my footing due to my not being able to tell where my foot was. This happens frequently due to my severe bouts of dizziness and due to my Neuropathy in my feet and legs. I fell backwards and br…

First Experience With Va
Hello All, I'm recently retired (SEP 2007) after 24 years service. I began the claims process while on active duty under the BDD program. My claim was submitted on April 23rd 2007 and boarded(decided?) 20 Dec 2007. I received the award letter in the mail on Dec 26th, 2007...I felt the process was pretty timely considering some of the dismal stories I've heard, the most frustrating part was having absolutely NO IDEA where my claim was during the interim period, regardless of IRIS queries or 1-800 calls. I submitted 32 separate items on my claim, figuring I'd go for broke while everything was still fresh and I had the inclination to comb thru my SMR on active duty. I re…

Requesting Records
A Statement of Case I received refers to a Medical Opinion. I sent an IRIS to ask for a copy of the opinion. They told me to send a written request and tell them what opinion I am referring to, since my husband's record is so "large." My questions are: 1. I REVIEWED his case file last July and didn't see any such medical opinion. Is it possible they have the date wrong? And they didn't request the opinion until October 2007 - instead of 2006? If so - should I mention that? (i.e. I don't want to spend forever waiting for this opinion only to receive a letter telling me their is NO opinion dated Oct. 19, 2006) Or since I AM asking for the opinion they referred to…

Statement Of The Case ?
In going over my paperwork, for the umteenth time, I was reading the part in the Statement of the Case where they list the pertinent Laws, Regulations; Rating Schedule Provisions: After reading the requirement necessary to change a diagnosis, it came to me. Shouldn't they have listed the Law and/or Regulation that gave them the right to make the change in the diagnosis? Here are two such Regulations that I feel should have been listed giving reason and basid to their decision, but they didn't. Least of which would have been the General Due Process Provisions under M21-1 which the basic right is that if any action proposed could result in denial, suspesion, reduction, o…

ptsd Should I File Multiple Claims At The Same Time?
Thanks in advance for your time viewing or replying! Since poring through my records after many helpful suggestions (special mention of Bertha, Thank you), I am realizing I will probably have several complex claims to address. Now that my blinders are off, I have been finding mistake upon mistake in my Ratings Decisions. Is it wise to send them all in on one or two NOD / Request for Reconsideration / SISC forms, or should I individualize them? Will it slow things down if I bombard them with several complex issues at once whether or not on one or many forms? Potentially I will be filing for TDIU, Change of EED on on several conditions, SC for six conditions…

Opinions On This Route
It has been suggested to me that I should apply for secondary condition of Reactive arthritis to the cyst which is 0%. It is already documented in my smr's and vamc's that I had this cyst and it was at times infected and they can't deny the cyst is service connected. ReA is caused from an infection thereby bypassing the 3.307 and trying to prove 10% rating within a year. Any raters willing to give opinion, I think this sounds good but I also think the HD needs to be rated. I guess I could just go to my primary and start getting it documented its infected. I would probably have another CE, which is fine with me.

Navy Blue-water Vn Vets Victory
Just got this e-mail from a Navy Buddy in San Francisco. VICTORY FOR "BLUE WATER NAVY" IN AGENT ORANGE EXPOSURE CASE -- U.S. Court of Appeals for Veterans Claims says VA's current "boots on the ground" definition of "service in the Republic of Vietnam" is "plainly erroneous...and unreasonable, and must be SET ASIDE." This is incredibly good news for the "Blue Water Navy" of the Vietnam era. The old "boots on the ground" definition is being thrown out.

diabetes Agent Orange Nehmer ,donnewsome, and Bwn
"(I now see why they went with aggrivated by) they gave me SC." To Donewsome: Ok- this explains your decision better- Aggravated by- is a lot different than directly due to- If you can ceg a better medical statement of the DMII "more than likely" causing the heart disease- with a full medical rationale- )plus that is a well known fact in the stadard medical community -ADA etc- as well as within the VA's own Diabetes training letter -that heart disease is (unless there is a very bonafide other medical etiology) CAD is most likely due to DMII-on most cases. This clarifies a lot here- you can sure fight this- "As for the person that said I couldn't get…

What Are They Doing?
Hi All, Can’t Figure out what VARO is doing I have a reconsideration with evidence form the VA Dr and also an IMO and have submitted all of that plus additional evidence. On my C&P my a contracted non-specialist Dr. naturally stated that I don’t have certain feet and ankle conditions – the same conditions that the VARO said I did have and were SC!! So several weeks ago they mailed me the usual duty to assist letter. I signed medical releases for my private Drs even though I turned most of that evidence in. I also checked the box on the VCAA to decide my case. So now they again sent me this same paperwork and like the other one they want me to show it wa…
