Deferred And Confused
I recently received a temporary rating of 100% as a result of surgery related to a service connected decision. Prior to this I had claims pending for depression and anxiety secondary to a service connected back condition and sinusitus. The same letter told me these were deferred but did not state for how long or why. The letter I recieved was from the DAV so it is not the official VA letter. Anyone have ideas as to what is going ob or what I can do?

Question On C.u.e.
I'm pretty sure that I have figured out how to present a CUE claim, except when it comes to where, for CUE to prevail, it must manifestly change the outcome. I can prove that the VA Claims Adjudicator failed to apply pertinate statutory and regulatory provision extent at the time that caused the clear and unmistakable error, But I am having trouble understanding what "Manifestly change the outcome" means. what types of outcomes are we talking about? Should I Claim It
<_< I posted yesterday about winning my claim going back to August of 04. Well today I finally took a moment and really read thru it. Yesterday I was on cloud 9 after a 3 ½ year battle I had finally won. The rateing of 10 percent for my neck and shoulder pain was a fair rateing. I told the C+P Doc the truth that I am not in pain every day but that some days are worse the others. Here were I have my big question. The examiner diagnosed cervical spondyloarthropathy most likely secondary to cervical degenerative disc disease with myofascial syndrome. Independent Living
I am wondering if there is anyone currently receiving Independent Living Assistance. I have been home for almost 2 years now after retiring and now I am just bored...who would have thought. <_< I was denied Voc Rehab due to my SC disability and I am receiving SSDI so I want to find something to do on my semi-good days especially now that most shows will be going on hiatus and reruns will start on shows that I watch daily.

Denied Due To Wrong Contact Info/ C&p Tomorrow
Hi all, I'm a 38 y/o firefighter, 1st Gulf War USMC vet. Currently 0% for my knee. Long story short, after a year I am finally getting my C&P exam tomorrow. I am in Rochester NY so I'm based out of Buffalo VA. I have had knee and back probs since my service (88-94). Knee is well documented, back just as a 'sprain" accordingto the navy doc. Filed for both upon discharge... never thought about it again. Went to college, blah, blah, blah. Collected GI Bill from discharge until 3 years later. Turns out my back is toast (two discs GONE in lower back. Doc says "you have made the wrong career choices son") and knee was exactly what Navy docs THOUGHT it wasall along…

ptsd Finished My Stuff
Wow, I was surprised and even shocked at times those SOB's. I really don't think they are there to make a diagnosis but to steer you into something other than PTSD. Very bizarre but I thought I handled it well even though he was looking for any other diagnosis than PTSD. I gave him my other Psyc Dr's letters right of the bat, looked them over and then after about 30 minutes he ask me "hows your relationship with your Dr?" my reply was he's a shrink there all the same you seen one you've seen them all, and ended his attack on one of my Dr's integrity and Dr. reports that deem me unemployable due to PTSD and this is one half of my claim. Appeals Cancellation
I filed an appeal 6 months ago and was told my BVA hearing could take upwards of 4 years. Since filing, I have additional compelling medical evidence to further substantiate my claim. Is there a provision for me to cancel the appeals process and submit the new evidence to a DRO? Or am I locked into the appeal for the duration?

I Was Just Told By Va That C-file
I was just told by the VA here in Chicago it is taking about 9 months to get a copy of a C-file. I was on a weird call, I have an NOD which was filed in June 2007, and I told the VA rep that I was thinking of getting a lawyer and she said you chose to let the DRO handle this. Can I still have a lawyer with having a DRO? Also when I told her I wanted to get an IME and that is why I wanted to get copy of C-file she automatically said I need to put you on hold and then came back and said I need to document this call what is your funny number.
