Entitlement - Veterans Compensation Benefits Claims
Once you know you are eligible for Veterans Disability Compensation, the question then becomes are you entitled to it by law. This is where to post those questions. it's OK, if you are feeling confused this is not at all unusual it can be a very confusing system. If you were injured in service and have a question about whether you are entitled to file a claim, post it here. Law 38C.F.R.3.4 (a)

Retroactive Pay?
Hi everyone, I'm seeking information on what to expect in retroactive pay and how soon they make that payment. My service ended Sept 2013 and I submitted my first claim on June 10 2014. I just received an award letter for 70% rating. I was wandering what would be the date of my retroactive pay and how soon to expect it? Thanks in advance!

ptsd Alcohol Abuse/cirrhosis Secondary To Ptsd
In April 2013 I had an initial exam for PTSD, the diagnoses were- Axis I 1. PTSD 2. Bipolar NOS 3. Alcohol abuse in full sustained remission (5 years) When I got my award 5 months later I was connected for "PTSD with bipolar disorder" but no mention of alcohol abuse. The examiners rational DID state, "claimant started drinking to deal with symptoms of ptsd". So, six weeks ago I filed a claim for Alcohol Abuse, secondary to PTSD with Bipolar disorder and submitted a copy of that C&P as a nexus statement. Will that suffice for a nexus or do I need to go out and get another one? My whole goal eventually is to get the cirrhosis covered, which I …

ptsd Award Changed To 90% + Other Benefits
Back after six months, which is pretty rude of me. The information I received from everyone here when my life went to hell was directly responsible for helping me through this. I cannot thank you guys and gals enough! I was originally rate at 80% and applied for TDUI after being unjustly fired for being a disabled vet. I applied in January and received the VA's decision last week. It has me more confused than ever. I have been bumped up to 90% with the following additions according to the letter; 1. Monthly Benefit - 3,400 (+1 dependant). 2. Dependants' Educational Assistance, Chapter 35 3. Individual Unemployability - Effective 9 Dec 14 4. Entitlement to…

hypertension The Importance Of Getting Your "c" File
asknod responded to a post located here on hadit This response made such a huge impact on me as to its importance; that I had to respond to it and start this thread: asknod wrote: You won because you took the time to learn the twisted system. Far too many come here and merely try to get others to do their footwork. Advice is one thing. Asking for a complete book of Cliff Notes is far more. No one is more invested in your claim, more knowledgeable than you about the actual facts, nor capable of bringing the proper legal arguments to the table. It took me 14 years to recognize my 1994 claim was actually still open in 2007 and not a "reopen". VA naturally fought me…

Anxiety/depression Rating Criteria
I understand mental health ratings are calculated at 10%, 30%, 50%, 70%, 100%. And the VA regs list the criteria considered in order to determine a specific rating. My question is this. Do they consider how these criteria impact the veteran when he is ON VA issued meds or how they affect him WITHOUT being on the meds?

ptsd Requesting Some Guidance
Hello, A few weeks back my claim was completed and went from 0- 90 % rating. I am still relatively unsure to the whole process of appealing and if I should .. I am grateful to be awarded the 90%. I have quite a few conditions also rated at 10% and not sure if I should appeal a few of them. A few questions: 1.) I was denied sleep apnea, I did sleep study Sep last year but was not fitted for CPAP and I have moderate OSA. I could not get fitted as I was in the process of moving at the time. I am getting CPAP next week at VA. Also I had a nasal fracture in 1995, and I have 70 % PTSD. would I have some grounds to appeal? 2.) There are a few claims I needed to…

Heart Attacks, Heart Disease//non Vietnam
Hello i have a general question. In 1998 i was transferring from a unit to independent duty as staff for active duty reserve staff. I had been treated for ppd and was given the antibiotic and otherwise was given the clean bill of health to transfer under those duty station strict criteria. I was also given a blood test as normal but at 25 they didn't tell me about my high triglycerides and excessively high cholesterol. 2 years later i was still not counseled ad was told my blood test were normal. I was never one to be very sick at any given point in time till sept 2009. i have gerd as well but i filed for sc and was given that at 10% sc in 2014. i was told by vs…

How To Read A Statement Of The Case (Screencast Video)
A Veteran gave me permission to "Screencast" his Statement of the Case (SOC), so I could explain to y'all how to read and understand this form. Take a look at this Screencast video, and tell me if it is helpful - if so, I will make a ton more of them for y'all. Finally Started A Claim
First - I want to thank you all for your service! For many years, I've struggled through my health issues as many of you have. I filed a claim which was denied in 2008 and decided to wait some time to refile. Why? I have no good answer! Nevertheless - I am at the earliest stages of the claim process having just delivered all requested documents to a county VA representative. My question is this - with all the VA Scandal News - have any of you found the process to have been sped up for claims approval OR is it just as long as it has always been? Is the VA more 'lax' or is the process just as stringent?
